(RADOGNO-FAWELL-O'MALLEY)

   235 ILCS 5/6-16           from Ch. 43, par. 131                             

        Amends the Liquor Control Act of 1934.  Provides that a  licensee      
   shall  not  sell,  give,  or  deliver  or authorize the sale, gift, or      
   delivery of alcohol to a person under the age of 21 years pursuant  to      
   a  plan or action to investigate, patrol, or otherwise conduct a sting      
   operation or enforcement action  against  a  person  employed  by  the      
   licensee   except  in  cooperation  with  a  law  enforcement  agency.      
   Effective immediately.                                                      
        HOUSE AMENDMENT NO. 1.                                                 
        Further amends the Liquor Control Act of 1934.  Provides  that  a      
   sting operation may be conducted only with written prior notice to the      
   law  enforcement  agency having jurisdiction, the local liquor control      
   commissioner,  or  both,  rather  than  in  cooperation  with  a   law      
   enforcement  agency.  Restores  provisions permitting possession of an      
   alcoholic beverage by a person under the age of 21 years who is making      
   a delivery of an alcoholic beverage in pursuance of the order  of  his      
   or her parent.                                                              
          FISCAL NOTE, H-AM 1 (DCCA)                                           
          HB 155, amended by H-am 1, imposes no additional requirements        
          and does not have a fiscal impact on units of local gov't.           
        SENATE AMENDMENT NO. 1.                                                
          Adds reference to:                                                   
          235 ILCS 5/6-16.1 new                                                
        Further amends the Liquor Control Act  of  1934.   Provides  that      
   notice   to   a   law  enforcement  agency  or  local  liquor  control      
   commissioner is valid only if it is provided at least 14 days before a      
   "sting  operation"  or  enforcement  action  and  for  60  days  after      
   provision of the notice unless the governing body of the  municipality      
   or county having jurisdiction shortens either of those periods.
