REITZ-SCOTT, O'BRIEN, SMITH,MICHAEL, HOFFMAN, DAVIS,STEVE, 
   GIGLIO, JONES,SHIRLEY, DAVIS,MONIQUE, BOST, JONES,JOHN, 
   MURPHY, SCHAKOWSKY, MCGUIRE, KENNER, HOWARD AND DART.

   5 ILCS 315/3              from Ch. 48, par. 1603                            

        Amends the Illinois Public Labor Relations Act.  Provides that no      
   employee shall be considered a "managerial employee" because (i) he or      
   she belongs to a classification of employees  to  whom  executive  and      
   management  functions  may  be  delegated  or  (ii) he or she performs      
   professional duties.   Provides  that  in  determining  an  employee's      
   status the labor board shall consider the employee's actual job duties      
   and  responsibilities  and the extent to which the employee has actual      
   authority concerning the overall  operations  and  governance  of  the      
   employee's office or workplace.  Effective immediately.

        HOUSE AMENDMENT NO. 1.                                                 
        Deletes all amendatory changes.  Amends the Illinois Public Labor      
   Relations Act to provide  that  no  employee  shall  be  considered  a      
   "managerial employee" because he or she belongs to a classification of      
   employees  to whom executive and management functions may be delegated      
   in the absence of proof that the employee has actually received such a      
   delegation on a regular basis.  Provides that the statutory  authority      
   of  an  employer  to delegate executive and management functions to an      
   employee shall not be determinative of  the  employee's  status  as  a      
   "managerial  employee".   Provides  that  an  employee  shall  not  be      
   considered   a  "managerial  employee"  because  he  or  she  performs      
   professional duties.   Provides  that  in  determining  an  employee's      
   status  as a "managerial employee" the labor board shall be limited to      
   considering the employee's actual job duties and responsibilities  and      
   the  extent  to which the employee has actual authority concerning the      
   overall operations and governance of the office in which the  employee      
   works.
