Short description: 
CARE FACILITIES-RETALIATION                                                

Synopsis of Bill as introduced:
        Amends the Community Living Facilities Licensing Act, the Nursing      
   Home Care Act, the Community-Integrated Living Arrangements  Licensure      
   and  Certification  Act,  and  the  Community Residential Alternatives      
   Licensing Act.  Provides that a facility or person licensed under  any      
   of  those  Acts who retaliates against a person because of a complaint      
   or testimony of suspected maltreatment shall be liable for damages and      
   attorney's fees.  Provides that there is a rebuttable presumption that      
   certain adverse actions, when taken within 90 days of  a  report,  are      
   retaliatory.  Effective immediately.                                        
          STATE MANDATES FISCAL NOTE                                           
          In the opinion of DCCA, HB797 fails to meet the definition of a      
          State mandate.
