Short description: 
PRIV SWIM POOL ENCLOSURE ACT                                               

Synopsis of Bill as introduced:
        Creates the Private Swimming Pool Enclosure Act  and  amends  the      
   Counties  Code  and  the  Illinois  Municipal Code.  Requires that new      
   outdoor swimming pools on private residential property be enclosed  by      
   a  fence,  wall,  or other effective permanent barrier of 42 inches or      
   greater height.  Provides that the provisions do not  apply  to  above      
   ground  pools  with  a  height  of  42  inches or more or to jacuzzis.      
   Permits more restrictive regulation by units of local  government  and      
   preempts less restrictive regulation by home rule units.                    
          STATE MANDATES FISCAL NOTE                                           
          In the opinion of DCCA, HB1009 fails to create a State mandate       
          under the State Mandates Act.                                        
          HOME RULE NOTE                                                       
          HB1009 does not preempt home rule authority.
