Effective immediately. SENATE AMENDMENT NO. 1. Deletes reference to: 415 ILCS 5/22.26 Adds reference to: 415 ILCS 5/39.2 from Ch. 111 1/2, par. 1039.2 Replaces the title and everything after the enacting clause. Amends the Environmental Protection Act to condition local siting approval of a sanitary landfill or waste disposal site on the facility being located outside the boundary of the 100 year flood plain. HOUSE AMENDMENT NO. 1. Deletes reference to: 415 ILCS 5/22.26 Adds reference to: 415 ILCS 5/22.19a new 415 ILCS 5/22.19b new 415 ILCS 5/39.2 from Ch. 111 1/2, par. 1039.2 Replaces the title and everything after the enacting clause. Amends the Environmental Protection Act to prohibit the development of sanitary landfills and waste disposal sites, except under specified conditions, within the boundary of the 100 year floodplain. Requires the Environmental Protection Agency to propose, and the Pollution Control Board to adopt, rules concerning financial assurance mechanisms to address the risks posed by flooding to sanitary landfills and waste disposal sites located within the boundary of the 100 year floodplain. Adds an immediate effective date.
