Short description: 
MENTAL HEALTH-SECURE TRANSPORT                                             

Synopsis of Bill as introduced:
        Amends the Code of Criminal Procedure of  1963  and  the  Unified      
   Code of Corrections.  Provides that a defendant who has been placed in      
   a  secure setting of the Department of Mental Health and Developmental      
   Disabilities (and, on and after July 1, 1997, the Department of  Human      
   Services)  and  who  is  being  transported to court hearings or other      
   appointments off facility  grounds  by  Department  personnel  may  be      
   placed  in  security  devices  or  otherwise  secured.   In provisions      
   relating to the treatment of unfit  defendants  and  those  found  not      
   guilty by reason of insanity, defines "facility director" as the chief      
   officer  of  a mental health or developmental facility (or a designee)      
   or the supervisor of a program of  treatment  or  habilitation  (or  a      
   designee).   Effective immediately.

          SB851 has no fiscal or prison population impact on DOC.

          There will be an increase in the number of judges in the state.

          Required additional 6 staff would cost $260,300 annually.
