 1        AN  ACT  to  amend  the Illinois Vehicle Code by changing
 2    Sections 11-205 and 11-907.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.  The  Illinois  Vehicle  Code  is  amended by
 6    changing Sections 11-205 and 11-907 as follows:

 7        (625 ILCS 5/11-205) (from Ch. 95 1/2, par. 11-205)
 8        Sec.  11-205.  Public  officers  and  employees  to  obey
 9    Act-Exceptions.
10        (a)  The provisions of this  Chapter  applicable  to  the
11    drivers  of  vehicles  upon  the  highways shall apply to the
12    drivers of all vehicles  owned  or  operated  by  the  United
13    States, this State or any county, city, town, district or any
14    other  political subdivision of the State, except as provided
15    in this Section and subject to such  specific  exceptions  as
16    set  forth  in  this  Chapter  with  reference  to authorized
17    emergency vehicles.
18        (b)  The driver of an authorized emergency vehicle,  when
19    responding  to an emergency call or when in the pursuit of an
20    actual or suspected violator of the law or when responding to
21    but not upon returning from a fire alarm,  may  exercise  the
22    privileges  set  forth  in  this  Section, but subject to the
23    conditions herein stated.
24        (c)  The driver of an authorized emergency vehicle may:
25             1.  Park or stand, irrespective of the provisions of
26        this Chapter;
27             2.  Proceed past a red or stop signal or stop  sign,
28        but  only  after  slowing  down  as  may  be required and
29        necessary for safe operation;
30             3.  Exceed the maximum speed limits so  long  as  he
31        does not endanger life or property;

 1             4.  Disregard  regulations  governing  direction  of
 2        movement or turning in specified directions.
 3        (d)  The  exceptions  herein  granted  to  an  authorized
 4    emergency  vehicle,  other than a police vehicle, shall apply
 5    only when the vehicle is making  use  of  either  an  audible
 6    signal   when   in  motion  or  visual  signals  meeting  the
 7    requirements of Section 12-215 of this Act.
 8        (e)  The foregoing provisions do not relieve  the  driver
 9    of  an  authorized emergency vehicle from the duty of driving
10    with due regard for the safety of all persons,  nor  do  such
11    provisions  protect  the  driver from the consequences of his
12    reckless disregard for the safety of others.
13        (f)  Unless specifically made applicable, the  provisions
14    of this Chapter, except those contained in Section 11-204 and
15    Articles  IV  and  V  of  this  Chapter,  shall  not apply to
16    persons, motor vehicles and equipment while actually  engaged
17    in  work  upon  a highway but shall apply to such persons and
18    vehicles when traveling to or from such work.
19        (g)  Nothing  in  this  Section   shall   supersede   the
20    provisions   of   the  Local  Governmental  and  Governmental
21    Employees Tort Immunity Act.

24        Sec. 11-907. Operation  of  vehicles  and  streetcars  on
25    approach  of  authorized  emergency  vehicles.  (a)  Upon the
26    immediate approach of an authorized emergency vehicle  making
27    use of audible and visual signals meeting the requirements of
28    this  Code  or  a police vehicle properly and lawfully making
29    use of an audible or visual signal,
30        (1)  the driver of every other vehicle  shall  yield  the
31    right-of-way  and  shall  immediately  drive  to  a  position
32    parallel to, and as close as possible to, the right-hand edge
33    or  curb  of the highway clear of any intersection and shall,

 1    if necessary to permit the  safe  passage  of  the  emergency
 2    vehicle,   stop   and  remain  in  such  position  until  the
 3    authorized emergency vehicle  has  passed,  unless  otherwise
 4    directed by a police officer and
 5        (2) the  operator  of  every  streetcar shall immediately
 6    stop such car clear of any intersection and keep it  in  such
 7    position  until  the authorized emergency vehicle has passed,
 8    unless otherwise directed by a police officer.
 9        (b)  This Section shall not operate to relieve the driver
10    of an authorized emergency vehicle from  the  duty  to  drive
11    with  due  regard  for  the  safety  of all persons using the
12    highway.
13        (c)  Nothing  in  this  Section   shall   supersede   the
14    provisions   of   the  Local  Governmental  and  Governmental
15    Employees Tort Immunity Act.
