1 AN ACT to amend the Code of Civil Procedure by adding
2 Section 2-1115.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Code of Civil Procedure is amended by
6 adding Section 2-1115.5 as follows:
7 (735 ILCS 5/2-1115.5 new)
8 Sec. 2-1115.5. Uninsured motorist; non-economic loss. A
9 person seeking damages of any kind arising from a motor
10 vehicle accident in which he or she was involved as a driver
11 is barred from any recovery for any non-economic loss if the
12 person was in violation of the mandatory liability insurance
13 requirements of Article VI of Chapter 7 of the Illinois
14 Vehicle Code with respect to the motor vehicle he or she was
15 driving at the time of the accident.
