 1        AN  ACT  to amend the Alcoholism and Other Drug Abuse and
 2    Dependency Act by changing Section 50-20.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The  Alcoholism  and  Other  Drug Abuse and
 6    Dependency Act  is  amended  by  changing  Section  50-20  as
 7    follows:

 8        (20 ILCS 301/50-20)
 9        Sec.  50-20.   Drunk and Drugged Driving Prevention Fund.
10    There is hereby created in the State treasury a special  fund
11    to be known as the Drunk and Drugged Driving Prevention Fund.
12    There  shall  be deposited into this Fund such amounts as may
13    be received pursuant to subsection (c)(2) of Section 6-118 of
14    the Illinois Vehicle Code.  Monies  in  this  fund  shall  be
15    appropriated  to  the Department and expended for the purpose
16    of making grants to reimburse  DUI  evaluation  and  remedial
17    education  programs  licensed by the Department for the costs
18    of providing  indigent  persons  with  free  or  reduced-cost
19    services  relating  to a criminal charge of driving under the
20    influence of alcohol or other drugs.  Monies in the Fund also
21    shall be appropriated to the Department for  the  purpose  of
22    making  grants  to  reimburse  counties for their expenses in
23    developing  and  implementing  programs  and  procedures   to
24    identify  and  redirect  delinquent  youth  under  Part  3 of
25    Article V of the Juvenile Court Act of 1987.  Monies  in  the
26    Drunk and Drugged Driving Prevention Fund may also be used to
27    enhance and support regulatory inspections and investigations
28    conducted  by  the  Department  under Article 45 of this Act.
29    The balance of the Fund on June 30 of each fiscal year,  less
30    the  amount  of  any expenditures attributable to that fiscal
31    year during the lapse period, shall  be  transferred  by  the

 1    Treasurer  to  the  General  Revenue  Fund  by  the following
 2    October 10.
