1 AMENDMENT TO HOUSE BILL 4165
2 AMENDMENT NO. . Amend House Bill 4165 on page 6, by
3 replacing line 34 with the following:
4 "(i) At any time after the Board awards racing dates
5 pursuant to the provisions of this Section 20, the acceptance
6 by the applicants of all racing dates awarded pursuant to
7 subsection (f-5), and the completion by applicants of all
8 required actions associated with the acceptance of those
9 racing dates pursuant to subsection (h), an applicant may
10 request changes in the formally executed order of its
11 previously awarded and accepted racing dates, provided that
12 the requested change does not alter the number of its
13 allotted racing dates by more than 5%. If the requested
14 change would not increase the number of racing days awarded
15 by the Board, the Board may act on the request at its next
16 scheduled meeting. If the requested change would increase
17 the number of racing days awarded by the Board, the Board
18 must provide at least 15 days prior written notice of the
19 proposed changes and the hearing date at which it will
20 consider the proposed changes to all applicants that applied
21 for racing dates for the years in which changes in the number
22 of racing days has been requested, to organization licensees
23 awarded racing dates in the years in which changes in the
24 number of racing days has been requested, and to all other

1 affected parties, as reasonably determined by the Board. An
2 opportunity shall be provided to all such applicants,
3 organization licensees, and other affected parties to provide
4 testimony at the hearing as to the requested changes in the
5 number of racing dates. The Illinois Administrative
6 Procedure Act shall not apply to the administrative
7 procedures of the Board in conducting a hearing concerning a
8 request in the number of racing days."; and
9 on page 7, by deleting lines 1 through 8.
