 1                    AMENDMENT TO HOUSE BILL 4176

 2        AMENDMENT NO.     .  Amend House Bill  4176  on  page  2,
 3    line   24,   by  replacing  "approved"  with  "most  recently
 4    adopted"; and

 5    on  page  2  by  replacing  lines  26  through  29  with  the
 6    following:
 7    "and conditional or situational  fields  as  defined  in  the
 8    NCPDP  Pharmacy  ID  Card  Implementation  Guide or successor
 9    document."; and

10    on page 2, line 33, by changing "data"  to  "data  elements";
11    and

12    on page 3, line 1, by changing "guide" to "guide or successor
13    document,   provided   that   change  affects  data  elements
14    contained on the card"; and

15    on page 3 by replacing lines 9 through 17 with the following:
16    "Assembly.  For purposes of this Act, a renewal of  a  health
17    benefit  plan  is  deemed to occur on the anniversary date of
18    the contract with the health benefit plan.
19        (b)  The Director may adopt rules necessary to  implement
20    the Department's responsibilities under this Act.  To enforce
21    the  provisions  of  this Act, the Director may issue a cease
22    and desist order or require a health benefit plan to submit a

 1    plan of correction for  violations  of  this  Act,  or  both.
 2    Subject  to  the  provisions  of  the Illinois Administrative
 3    Procedure Act, the Director may, pursuant to Section 403A  of
 4    the  Illinois  Insurance  Code,  impose upon a health benefit
 5    plan an  administrative  fine  not  to  exceed  $250,000  for
 6    failure  to submit a requested plan of correction, failure to
 7    comply with its plan or correction, or repeated violations of
 8    this Act.

 9        Section 99.  Effective date.  This Act  takes  effect  on
10    January 1, 2001.".
