 1                    AMENDMENT TO HOUSE BILL 4478

 2        AMENDMENT NO.     .  Amend House Bill 4478,  AS  AMENDED,
 3    in  Section  15,  by replacing all of subsection (a) with the
 4    following:
 5        "(a)  The  Health  Care  Services  Contracting  Board  is
 6    created within the Office of the Attorney General.  The Board
 7    shall be advisory to the Attorney General and  shall  consist
 8    of   an  equal  number  of  representatives  of  health  care
 9    providers, health care plans, and public  members  who  shall
10    not  be  engaged  in  any  way,  directly  or  indirectly, as
11    providers of health care  services  or  with  a  health  care
12    plan."; and

13    in  Section  15,  subsection  (b),  in the first sentence, by
14    replacing "Governor" with "Attorney General"; and

15    in Section  15,  subsection  (b),  by  replacing  the  second
16    sentence  with "The initial Board shall have one-third of its
17    members appointed  for  a  term  expiring  January  1,  2002;
18    one-third  of  its  members  appointed  for  a  term expiring
19    January 1, 2003; and one-third of its members appointed for a
20    term expiring January 1, 2004."; and

21    in Section 15, subsection (c),  in  the  first  sentence,  by

 7        "(e) The Board may conduct business upon the presence  of
 8    a  quorum  of  a  majority  of the voting members.  The Board
 9    shall make recommendations to the Attorney General concerning
10    the duties of the Attorney General under this Act."; and

11    in Section 20, in the  caption,  by  replacing  "Board"  with
12    "Attorney General"; and

 7    a  joint  discussion  representative to discuss with a health
 8    care plan or to agree to any health  care  plan  policies  to
 9    exclude,  limit  the  participation  or  reimbursement of, or
10    otherwise limit the services of  health  care  providers  not
11    represented  by  the  health care provider's joint discussion
12    representative.  Any such plan policies are void and  against
13    public  policy.   Nothing  in  this Act shall be construed to
14    permit, require, or authorize  any  individual  or  group  of
15    health  care  providers  to  provide  services not within the
16    scope of their license or authorization.
17        (g) Nothing in this Act  shall  require  any  Independent
18    Practice  Association  or  Physician Hospital Organization to
19    utilize the services of a joint discussion representative  or
20    be licensed under this Act."; and
