 1        AN ACT to amend the Consumer Fraud and Deceptive Business
 2    Practices Act by adding Section 2JJ.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The Consumer  Fraud  and  Deceptive  Business
 6    Practices Act is amended by adding Section 2JJ as follows:

 7        (815 ILCS 505/2JJ new)
 8        Sec.  2JJ.   Advertising;  rebates.   It  is  an unlawful
 9    practice under this Act  for  a  retailer  to  advertise  the
10    availability of a manufacturer's rebate by displaying the net
11    price  of the advertised item in the advertisement unless the
12    amount of the manufacturer's rebate is  discounted  from  the
13    purchase  price of the advertised item at the time of sale to
14    the consumer.  A retailer is  not  required  to  provide  the
15    purchaser  of  an  advertised  item  with  the  amount of the
16    manufacturer's rebate  if  the  retailer  advertises  that  a
17    manufacturer's  rebate  is  available without stating the net
18    price of the item in the advertisement.    In  this  Section,
19    "net price" means the ultimate price paid by a consumer after
20    he  or  she redeems the manufacturer's rebate offered for the
21    advertised item.  In this Section, "retailer" has the meaning
22    ascribed to that term in the Use Tax Act.
