HASSERT-CROSS-KOSEL-GARRETT-MATHIAS, FRANKS, 
   MOORE,ANDREA, BELLOCK, LYONS,EILEEN, DURKIN AND OSMOND.

(PETERSON-KLEMM)

   720 ILCS 5/17-23 new                                                        

        Amends the Criminal Code of 1961.  Creates the offense of  taking      
   the  identity of another person.  Provides that it is unlawful to take      
   the name, birth date, or social security  number  of  another  person,      
   without  that  other person's consent and with the intent to obtain or      
   use the other person's identity for an unlawful purpose  or  to  cause      
   economic  loss to another person. Provides that the penalty is a Class      
   A misdemeanor unless the taking of the identity of another  person  is      
   for  the  purpose  of evading a peace officer.  Taking the identity of      
   another person for the purpose of evading a peace officer is a Class 4      
   felony.

        Deletes the title  and  everything  after  the  enacting  clause.      
   Amends  the  Criminal  Code of 1961.  Creates the offense of financial      
   identity theft.   Provides  that  it  is  unlawful  to  knowingly  use      
   personal identifying information or a personal identification document      
   of  another  person to obtain credit, money, goods, services, or other      
   property in  the  name  of  the  other  person,  without  the  written      
   authorization  of  the other person and knowingly representing that he      
   or she is the other person or is acting with the authorization of  the      
   other  person.  Creates  the  offense of aggravated financial identity      
   theft defined as committing the offense of  financial  identity  theft      
   against  a  person  at  least  60  years  of age or against a disabled      
   person. Effective immediately.
