1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by changing Section 2310-600 as follows:
 
7    (20 ILCS 2310/2310-600)
8    Sec. 2310-600. Advance directive information.
9    (a) The Department of Public Health shall prepare and
10publish the summary of advance directives law, as required by
11the federal Patient Self-Determination Act, and related forms.
12Publication may be limited to the World Wide Web. The summary
13required under this subsection (a) must include the Department
14of Public Health Uniform POLST form.
15    (b) The Department of Public Health shall publish Spanish
16language versions of the following:
17        (1) The statutory Living Will Declaration form.
18        (2) The Illinois Statutory Short Form Power of
19    Attorney for Health Care.
20        (3) The statutory Declaration of Mental Health
21    Treatment Form.
22        (4) The summary of advance directives law in Illinois.
23        (5) The Department of Public Health Uniform POLST

3    (b-5) In consultation with a statewide professional
4organization representing physicians licensed to practice
5medicine in all its branches, statewide organizations
6representing physician assistants, advanced practice
7registered nurses, nursing homes, registered professional
8nurses, and emergency medical systems, and a statewide
9organization representing hospitals, the Department of Public
10Health shall develop and publish a uniform form for
11practitioner cardiopulmonary resuscitation (CPR) or
12life-sustaining treatment orders that may be utilized in all
13settings. The form shall meet the published minimum
14requirements to nationally be considered a practitioner orders
15for life-sustaining treatment form, or POLST, and may be
16referred to as the Department of Public Health Uniform POLST
17form. An electronic version of the Uniform POLST form under
18this Act may be created, signed, or revoked electronically
19using a generic, technology-neutral system in which each user
20is assigned a unique identifier that is securely maintained
21and in a manner that meets the regulatory requirements for a
22digital or electronic signature. Compliance with the standards
23defined in the Uniform Electronic Transactions Act or the
24implementing rules of the Hospital Licensing Act for medical
25record entry authentication for author validation of the
26documentation, content accuracy, and completeness meets this

1standard. This form does not replace a physician's or other
2practitioner's authority to make a do-not-resuscitate (DNR)
3order.
4    (b-10) In consultation with a statewide professional
5organization representing physicians licensed to practice
6medicine in all its branches, statewide organizations
7representing physician assistants, advanced practice
8registered nurses, nursing homes, registered professional
9nurses, and emergency medical systems, a statewide bar
10association, a national bar association with an Illinois
11chapter that concentrates in elder and disability law, a
12not-for-profit organ procurement organization that coordinates
13organ and tissue donation, a statewide committee or group
14responsible for stakeholder education about POLST issues, and
15a statewide organization representing hospitals, the
16Department of Public Health shall study the feasibility of
17creating a statewide registry of advance directives and POLST
18forms. The registry would allow residents of this State to
19submit the forms and for the forms to be made available to
20health care providers and professionals in a timely manner for
21the provision of care or services. This study must be filed
22with the General Assembly on or before January 1, 2021.
23    (b-15) The Department of Public Health shall approve
24training resources to support informed decisions and accurate
25completion of the Department of Public Health Uniform POLST
26form. The Department of Public Health shall post approved

1POLST training material to the Department of Public Health's
2website. The Department of Public Health shall establish a
3simple, efficient, and effective process to make available
4yearly training to support informed decisions and accurate
5completion of the Department of Public Health Uniform POLST
6form for personnel employed by or contracted with facilities
7licensed and classified to provide intermediate care or
8skilled nursing care under the Nursing Home Care Act and other
9health care providers that use the Department of Public Health
10Uniform POLST form.
11    (c) (Blank).
12    (d) The Department of Public Health shall publish the
13Department of Public Health Uniform POLST form reflecting the
14changes made by this amendatory Act of the 98th General
15Assembly no later than January 1, 2015.
