SYNOPSIS AS INTRODUCED:

220 ILCS 5/16-126.2 new

Amends the Electric Service Customer Choice and Rate Relief Law of 1997 of the Public Utilities Act. Provides that a public service company that is a member of a Regional Transmission Organization shall submit a report to the Illinois Commerce Commission on or before February 1 of each year of any recorded vote cast by the public service company during the immediately preceding calendar year. Provides that a public service company that is a member of a Regional Transmission Organization shall include in the report any recorded vote cast by an affiliate at a meeting of a Regional Transmission Organization during the immediately preceding calendar year. Provides that the report shall include: (i) all recorded votes cast by the public service company, regardless of whether the vote is otherwise disclosed; (ii) all votes cast by an affiliate of the public service company, if the public service company did not vote on the matter; and (iii) a brief description explaining how each vote cast by the public service company or its affiliate, as appropriate, is in the interest of the public.

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Public Utilities Act is amended by adding Section 16-126.2 as follows:

Sec. 16-126.2. Recorded votes report.

(a) Definitions. In this Section:

"Affiliate" has the meaning given in Section 7-108.

"Meeting" means any committee, user group, task force or other part of the Regional Transmission Organization in which votes are taken.

"Recorded vote" means any final or non-final vote that is tabulated, individually or as part of a sector, for any purpose at a meeting, regardless of (i) whether the vote represents a final position of any entity casting a vote or (ii) the decision-making authority of those voting.

"Regional Transmission Organization" means an entity that qualifies as a Regional Transmission Organization under 18 CFR 35.34.

(b) On or before February 1 of each year, each public service company that is a member of a Regional Transmission Organization shall submit to the Commission a report of any recorded vote cast by the public service company or, subject to the limitation in subsection (c), an affiliate of the public service company at a meeting of a Regional Transmission Organization during the immediately preceding calendar year.

(c) The report required under subsection (b) shall include (i) all recorded votes cast by the public service company, regardless of whether the vote is otherwise disclosed, (ii) all votes cast by an affiliate of the public service company, if the public service company did not vote on the matter, and (iii) a brief description explaining how each vote cast by the public service company or its affiliate, as appropriate, is in the interest of the public.
