| 1 | AN ACT concerning regulation. | |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||
| 4 | Section 5. The Department of Professional Regulation Law | |||||||||||||||||||
| 5 | of the Civil Administrative Code of Illinois is amended by | |||||||||||||||||||
| 6 | adding Section 2105-410 as follows: | |||||||||||||||||||
| 7 | (20 ILCS 2105/2105-410 new) | |||||||||||||||||||
| 8 | Sec. 2105-410. Temporary professional licensure for | |||||||||||||||||||
| 9 | military members, military spouses, and veterans. | |||||||||||||||||||
| 10 | (a) The purpose of this Section is to facilitate | |||||||||||||||||||
| 11 | employment opportunities for active-duty military members, | |||||||||||||||||||
| 12 | military spouses, and veterans by allowing temporary practice | |||||||||||||||||||
| 13 | under an out-of-state professional license while completing | |||||||||||||||||||
| 14 | State licensure requirements. | |||||||||||||||||||
| 15 | (b) As used in this Section: | |||||||||||||||||||
| 16 | "Active-duty military member" means a person serving in | |||||||||||||||||||
| 17 | the United States Armed Forces on active duty. | |||||||||||||||||||
| 18 | "Military spouse" means the spouse of an active-duty | |||||||||||||||||||
| 19 | military member. | |||||||||||||||||||
| 20 | "Professional license or certificate" means a license, | |||||||||||||||||||
| 21 | permit, certification, or other authorization required by law | |||||||||||||||||||
| 22 | to practice or work in a profession or occupation. | |||||||||||||||||||
| 23 | "Temporary permit" means a 3-year, non-renewable | |||||||||||||||||||
| |||||||
| |||||||
| 1 | authorization to practice in this State under this Section. | ||||||
| 2 | "Veteran" means an individual who has served in the United | ||||||
| 3 | States Armed Forces and received an honorable or general | ||||||
| 4 | discharge. | ||||||
| 5 | (c) To be eligible for a temporary permit, an applicant | ||||||
| 6 | must meet all of the following requirements: | ||||||
| 7 | (1) The applicant must be an active-duty military | ||||||
| 8 | member, military spouse, or veteran. | ||||||
| 9 | (2) The applicant must hold a valid, unencumbered | ||||||
| 10 | professional license or certificate in good standing from | ||||||
| 11 | another state. | ||||||
| 12 | (3) The applicant must provide proof of: | ||||||
| 13 | (A) residency in this State or relocation to this | ||||||
| 14 | State due to military orders; and | ||||||
| 15 | (B) the applicant's military status or the | ||||||
| 16 | applicant's spouse's military status, which may be | ||||||
| 17 | established through a military identification card, a | ||||||
| 18 | Certificate of Release or Discharge from Active Duty | ||||||
| 19 | (DD-214), or equivalent documentation. | ||||||
| 20 | The Department shall issue a temporary permit upon the | ||||||
| 21 | receipt of a completed application and a verification of | ||||||
| 22 | eligibility. Temporary permits are valid for 3 years from the | ||||||
| 23 | date of issuance and shall not be renewed. | ||||||
| 24 | (d) A temporary permitholder may practice within the scope | ||||||
| 25 | of the permitholder's out-of-state license if the permitholder | ||||||
| 26 | complies with all State laws, rules, regulations, and | ||||||

| 1 | standards of practice applicable to the permitholder's | ||||||
| 2 | profession. | ||||||
| 3 | (e) To obtain a permanent State license, a temporary | ||||||
| 4 | permitholder must meet all State licensure requirements before | ||||||
| 5 | the expiration of the 3-year period under subsection (c). | ||||||
| 6 | Failure to obtain permanent licensure within the 3-year | ||||||
| 7 | period under subsection (c) shall result in the termination of | ||||||
| 8 | the temporary permit. | ||||||
| 9 | (f) A temporary permit shall not be issued for a | ||||||
| 10 | profession that requires a licensee to have emergency or | ||||||
| 11 | public safety certifications unless the issuance of the | ||||||
| 12 | temporary permit is authorized by the licensing board of the | ||||||
| 13 | profession. | ||||||
| 14 | This Section does not apply to a license governed by an | ||||||
| 15 | interstate licensure compact unless the applicable interstate | ||||||
| 16 | licensure compact provides otherwise. | ||||||
| 17 | (g) The Department may adopt rules necessary to implement | ||||||
| 18 | this Section. | ||||||
| 19 | Section 99. Effective date. This Act takes effect January | ||||||
| 20 | 1, 2026. | ||||||
