SYNOPSIS AS INTRODUCED:

20 ILCS 2105/2105-410 new

Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Provides for a temporary permit, which is a 3-year, non-renewable authorization to practice in this State, for active duty military members, military spouses, and veterans. Provides eligibility and application requirements for a temporary permit. Provides that temporary permits are valid for 3 years from the date of issuance and shall not be renewed. Provides that a temporary permitholder may practice within the scope of the permitholder's out-of-state license if the permitholder complies with all State laws, rules, regulations, and standards of practice applicable to the permitholder's profession. Provides that a temporary permit shall not be issued for a profession requiring emergency or public safety certifications unless the issuance of the temporary permit is authorized by the licensing board of the profession. Sets forth provisions concerning definitions; permanent licensure; and rulemaking. Effective January 1, 2026.

A BILL FOR

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Department of Professional Regulation Law of the Civil Administrative Code of Illinois is amended by adding Section 2105-410 as follows:

Sec. 2105-410. Temporary professional licensure for military members, military spouses, and veterans.

(a) The purpose of this Section is to facilitate employment opportunities for active-duty military members, military spouses, and veterans by allowing temporary practice under an out-of-state professional license while completing State licensure requirements.

(b) As used in this Section:

"Active-duty military member" means a person serving in the United States Armed Forces on active duty.

"Military spouse" means the spouse of an active-duty military member.

"Professional license or certificate" means a license, permit, certification, or other authorization required by law to practice or work in a profession or occupation.

"Temporary permit" means a 3-year, non-renewable authorization to practice in this State under this Section.

"Veteran" means an individual who has served in the United States Armed Forces and received an honorable or general discharge.

(c) To be eligible for a temporary permit, an applicant must meet all of the following requirements:

(1) The applicant must be an active-duty military member, military spouse, or veteran.

(2) The applicant must hold a valid, unencumbered professional license or certificate in good standing from another state.

(3) The applicant must provide proof of:

(A) residency in this State or relocation to this State due to military orders; and

(B) the applicant's military status or the applicant's spouse's military status, which may be established through a military identification card, a Certificate of Release or Discharge from Active Duty (DD-214), or equivalent documentation.

The Department shall issue a temporary permit upon the receipt of a completed application and a verification of eligibility. Temporary permits are valid for 3 years from the date of issuance and shall not be renewed.

(d) A temporary permitholder may practice within the scope of the permitholder's out-of-state license if the permitholder complies with all State laws, rules, regulations, and standards of practice applicable to the permitholder's profession.

(e) To obtain a permanent State license, a temporary permitholder must meet all State licensure requirements before the expiration of the 3-year period under subsection (c).

Failure to obtain permanent licensure within the 3-year period under subsection (c) shall result in the termination of the temporary permit.

(f) A temporary permit shall not be issued for a profession that requires a licensee to have emergency or public safety certifications unless the issuance of the temporary permit is authorized by the licensing board of the profession.

This Section does not apply to a license governed by an interstate licensure compact unless the applicable interstate licensure compact provides otherwise.

(g) The Department may adopt rules necessary to implement this Section.

Section 99. Effective date. This Act takes effect January 1, 2026.
