SYNOPSIS AS INTRODUCED:
 
745 ILCS 65/4  from Ch. 70, par. 34
745 ILCS 65/6  from Ch. 70, par. 36
    Amends the Recreational Use of Land and Water Areas Act. Provides that an owner of land who invites any person without charge to use the owner's property for recreational or conservation purposes does not assume liability for injuries under the Act unless there is a willful and wanton failure t guard or warn against a dangerous condition, use, structure, or activity. Provides that the changes to the Act made by the amendatory Act apply only to causes of action accruing on or after the effective date of the amendatory Act.

A BILL FOR

1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois, 
3represented in the General Assembly:
 
4    Section 5. The Recreational Use of Land and Water Areas 
5Act is amended by changing Sections 4 and 6 as follows:
 
6    (745 ILCS 65/4)  (from Ch. 70, par. 34)
7    Sec. 4. Except as specifically recognized by or provided 
8in Section 6 of this Act, an owner of land who permits or 
9invites without charge any person to use such property for 
10recreational or conservation purposes does not thereby:
11        (a) Extend any assurance that the premises are safe 
12    for any purpose.
13        (b) (Blank).
14        (c) Assume responsibility for or incur liability for 
15    any injury to person or property caused by an act or 
16    omission of such person or any other person who enters 
17    upon the land.
18        (d) Assume responsibility for or incur liability for 
19    any injury to such person or property caused by any 
20    natural or artificial condition, structure or personal 
21    property on the premises.
22    The changes to this Section made by this amendatory Act of 
23the 98th General Assembly apply only to causes of action

1accruing on or after the effective date of this amendatory Act 
2of the 98th General Assembly. 
3    The changes to this Section made by this amendatory Act of 
4the 104th General Assembly apply only to causes of action 
5accruing on or after the effective date of this amendatory Act 
6of the 104th General Assembly.

9    Sec. 6. Nothing in this Act limits in any way any liability 
10which otherwise exists:
11        (a) For willful and wanton failure to guard or warn 
12    against a dangerous condition, use, structure, or 
13    activity.
14        (b) For injury suffered in any case where the owner of 
15    land invites, as defined in subsection (f) of Section 2 of 
16    this Act, or charges the person or persons who enter or go 
17    on the land for the recreational use thereof.
18    The changes to this Section made by this amendatory Act of 
19the 98th General Assembly apply only to causes of action 
20accruing on or after the effective date of this amendatory Act 
21of the 98th General Assembly. 
22    The changes to this Section made by this amendatory Act of 
23the 104th General Assembly apply only to causes of action 
24accruing on or after the effective date of this amendatory Act 
25of the 104th General Assembly.
