| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 5. The Illinois Dental Practice Act is amended by |
| 5 | | changing Section 17.2 as follows: |
| 6 | | (225 ILCS 25/17.2) |
| 7 | | (Section scheduled to be repealed on January 1, 2026) |
| 8 | | Sec. 17.2. Teledentistry. |
| 9 | | (a) As used in this Section, "patient of record" means a |
| 10 | | patient for whom the patient's most recent Illinois-licensed |
| 11 | | dentist has obtained a relevant medical and dental history and |
| 12 | | on whom the dentist has (i) performed a physical examination |
| 13 | | within the last year; (ii) obtained relevant records that are |
| 14 | | appropriate for the type of teledentistry service being |
| 15 | | provided from an in-person examination within the previous 12 |
| 16 | | months, including a review of the patient's most recent |
| 17 | | x-rays; or (iii) established a relationship with the patient |
| 18 | | through an exchange of protected health information for the |
| 19 | | purpose of providing emergency care, treatment, or services in |
| 20 | | accordance with subsection (c). |
| 21 | | (b) A dentist may only practice or utilize teledentistry |
| 22 | | on a patient of record. A dentist practicing dentistry through |
| 23 | | teledentistry is subject to the same standard of care and |

| 1 | | practice standards that are applicable to dental services |
| 2 | | provided in a clinic or office setting. A dentist may provide |
| 3 | | and delegate dental services using teledentistry only under |
| 4 | | the supervision requirements as specified in this Act for |
| 5 | | in-person care. Prior to providing teledentistry services to a |
| 6 | | patient, a dentist must obtain informed consent from the |
| 7 | | patient as to the treatment proposed to be offered through |
| 8 | | teledentistry by the dentist. A dentist providing |
| 9 | | teledentistry under this Section shall provide the patient |
| 10 | | with the his or her name, direct telephone number, and |
| 11 | | physical practice address. It is a violation of this Act for a |
| 12 | | provider of dental services rendering care through |
| 13 | | teledentistry to require a patient to sign an agreement that |
| 14 | | limits in any way the patient's ability to write a review of |
| 15 | | services received or file a complaint with the Department or |
| 16 | | other regulatory agency. The Department shall adopt rules to |
| 17 | | provide for the use of teledentistry in the State of Illinois. |
| 18 | | (c) A dentist may treat a patient of record to provide |
| 19 | | emergent care or conduct an initial consultation using |
| 20 | | teledentistry for the purpose of treating or assessing for |
| 21 | | acute pain, infection, injury, or any intraoral or perioral |
| 22 | | condition that presents immediate harm or discomfort to the |
| 23 | | patient for which treatment cannot be postponed. A provider of |
| 24 | | dental services rendering emergent care or conducting an |
| 25 | | initial consultation through teledentistry must direct the |
| 26 | | patient to receive appropriate in-person care after the |

| 1 | | provision of teledentistry services. |
| 2 | | (d) A patient of record who is provided services through a |
| 3 | | mobile dental van or portable dental unit, as defined in |
| 4 | | Section 4, does not need to receive an in-person physical |
| 5 | | examination from a dentist prior to receiving treatment that |
| 6 | | utilizes teledentistry if such services are limited to the |
| 7 | | diagnostic, preventive, and periodontal procedures permitted |
| 8 | | within this Act. |
