| 1 | AN ACT concerning State government. | |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||
| 4 | Section 5. The Substance Use Disorder Act is amended by | |||||||||||||||||||
| 5 | adding Section 5-35 as follows: | |||||||||||||||||||
| 6 | (20 ILCS 301/5-35 new) | |||||||||||||||||||
| 7 | Sec. 5-35. State Fetal Alcohol Spectrum Disorders (FASD) | |||||||||||||||||||
| 8 | Program. | |||||||||||||||||||
| 9 | (a) General. There is established a comprehensive fetal | |||||||||||||||||||
| 10 | alcohol spectrum disorders (FASD) awareness, prevention, | |||||||||||||||||||
| 11 | identification, intervention, and service delivery program | |||||||||||||||||||
| 12 | (program) in the State of Illinois which may include, but is | |||||||||||||||||||
| 13 | not limited to, the following activities: | |||||||||||||||||||
| 14 | (1) Designating a State FASD coordinator with | |||||||||||||||||||
| 15 | knowledge and experience in the field of prenatal alcohol | |||||||||||||||||||
| 16 | exposure and FASD. | |||||||||||||||||||
| 17 | (2) Utilizing and adapting existing federal or State | |||||||||||||||||||
| 18 | programs to include FASD identification and FASD-informed | |||||||||||||||||||
| 19 | support. | |||||||||||||||||||
| 20 | (3) Developing and expanding screening and diagnostic | |||||||||||||||||||
| 21 | capacity for FASD. | |||||||||||||||||||
| 22 | (4) Developing, implementing, and evaluating targeted | |||||||||||||||||||
| 23 | FASD-informed intervention programs for FASD. | |||||||||||||||||||
| |||||||
| |||||||
| 1 | (5) Increasing awareness of FASD. | ||||||
| 2 | (6) Providing training with respect to FASD for | ||||||
| 3 | professionals across relevant sectors. | ||||||
| 4 | (7) Serving as a centralized resource for issues | ||||||
| 5 | related to FASD and disseminating information about FASD | ||||||
| 6 | and support services to affected individuals and their | ||||||
| 7 | families. | ||||||
| 8 | (b) As used in this Section, "fetal alcohol spectrum | ||||||
| 9 | disorders" or "FADS" refers to a range of effects that can | ||||||
| 10 | occur in an individual who has been prenatally exposed to | ||||||
| 11 | alcohol. Prenatal alcohol exposure is the leading cause of | ||||||
| 12 | preventable developmental disabilities, including over 400 | ||||||
| 13 | co-occurring possible disease conditions, impacting the brain, | ||||||
| 14 | vision, hearing, heart, circulation, digestion, and | ||||||
| 15 | musculoskeletal and respiratory systems. FASD includes | ||||||
| 16 | diagnoses such as Fetal Alcohol Syndrome (FAS), partial Fetal | ||||||
| 17 | Alcohol Syndrome (pFAS), Alcohol-Related Neurodevelopmental | ||||||
| 18 | Disorder (ARND), Static Encephalopathy-Alcohol Exposed | ||||||
| 19 | (SE-AE), Neurobehavioral Disorders Associated with Prenatal | ||||||
| 20 | Alcohol Exposure (NDPAE), and alcohol-related birth defects. | ||||||
| 21 | (c) Lead agency. The Governor shall designate the | ||||||
| 22 | Department of Human Services as the sole agency responsible | ||||||
| 23 | for the administration of the program established under | ||||||
| 24 | subsection (a). | ||||||
| 25 | (d) FASD State Advisory Committee. | ||||||
| 26 | (1) Purpose. A FASD State Advisory Committee is | ||||||
| |||||||
| |||||||
| 1 | established to provide guidance for the FASD State Program | ||||||
| 2 | to prevent FASD and provide for the identification, | ||||||
| 3 | treatment, and support of individuals with FASD and their | ||||||
| 4 | families. Activities of the committee may include, but is | ||||||
| 5 | not limited to: | ||||||
| 6 | (A) developing a statewide strategic plan to | ||||||
| 7 | substantially reduce prenatal alcohol exposure and | ||||||
| 8 | provide for the identification, treatment, and support | ||||||
| 9 | of individuals with FASD and their families; | ||||||
| 10 | (B) providing guidance on the implementation of | ||||||
| 11 | the strategic plan by reviewing and commenting on | ||||||
| 12 | grant proposals addressing prenatal alcohol and | ||||||
| 13 | substance exposure and FASD-informed supports and | ||||||
| 14 | interventions; | ||||||
| 15 | (C) identifying existing federal or State agency | ||||||
| 16 | programs related to prenatal alcohol and substance | ||||||
| 17 | exposure and FASD and making recommendations for the | ||||||
| 18 | utilization and adaptation of such programs to include | ||||||
| 19 | prenatal alcohol screening and FASD-informed supports | ||||||
| 20 | and interventions; and | ||||||
| 21 | (D) reviewing programs of State agencies that | ||||||
| 22 | relate to prenatal alcohol or substance exposure and | ||||||
| 23 | FASD, and coordinating such programs that are | ||||||
| 24 | interdepartmental in nature in accordance with an | ||||||
| 25 | interagency agreement, whenever feasible. | ||||||
| 26 | (2) Composition. The FASD Advisory Committee shall | ||||||
| |||||||
| |||||||
| 1 | consist of: | ||||||
| 2 | (A) The Department heads, or their senior level | ||||||
| 3 | designees, of the following State agencies: | ||||||
| 4 | (i) Department of Healthcare and Family | ||||||
| 5 | Services. | ||||||
| 6 | (ii) Department of Human Services. | ||||||
| 7 | (iii) Department of Corrections. | ||||||
| 8 | (iv) Illinois State Police. | ||||||
| 9 | (v) Department of Employment Security. | ||||||
| 10 | (vi) Illinois State Board of Education. | ||||||
| 11 | (B) No more than 7 members from the public | ||||||
| 12 | representing health, education, and justice professionals | ||||||
| 13 | and service providers, and at least 3 members with FASD or | ||||||
| 14 | who have a family member with FASD. The Governor shall | ||||||
| 15 | appoint all members described in this subparagraph. | ||||||
| 16 | (3) Each member shall serve for a term of 4 years. If a | ||||||
| 17 | vacancy occurs in the committee membership, the vacancy shall | ||||||
| 18 | be filled in the same manner as the original appointment for | ||||||
| 19 | the remainder of the unexpired term. Members shall serve | ||||||
| 20 | without compensation but shall be reimbursed for necessary | ||||||
| 21 | expenses incurred in the performance of their duties. | ||||||
| 22 | The committee shall elect a chair from its membership. | ||||||
| 23 | (4) Administrative support. The Secretary of Human | ||||||
| 24 | Services shall designate a FASD State Coordinator to provide | ||||||
| 25 | administrative support for the committee. | ||||||
| 26 | (5) Reports. The committee shall report from time to time | ||||||
| |||||||
| |||||||
| 1 | on its activities to the Governor, the chairs of the | ||||||
| 2 | appropriate policy committees of the House of Representatives | ||||||
| 3 | and Senate, and to the Department of Human Services. The | ||||||
| 4 | committee shall file a formal report with the Governor not | ||||||
| 5 | later than October 15 of each even-numbered year so that the | ||||||
| 6 | information contained in the report, including | ||||||
| 7 | recommendations, can be included in the Governor's Budget | ||||||
| 8 | Address to the General Assembly. It shall also report to the | ||||||
| 9 | chairs of the appropriate policy committees of the House of | ||||||
| 10 | Representatives and Senate not later than November 15 of each | ||||||
| 11 | even-numbered year. | ||||||
| 12 | (e) Federal funds; contracts. The Department of Human | ||||||
| 13 | Services may apply for, receive, and disburse federal funds | ||||||
| 14 | made available to the State by federal law or rules adopted for | ||||||
| 15 | any purpose related to the powers and duties of the Department | ||||||
| 16 | that are consistent with the purposes of this Section. The | ||||||
| 17 | Department shall comply with any requirements of federal law, | ||||||
| 18 | rules, and regulations to apply for, receive, and disburse | ||||||
| 19 | funds. The Department may contract with or provide grants to | ||||||
| 20 | public and private nonprofit entities for FASD programs set | ||||||
| 21 | forth in subsection (a). | ||||||
