SYNOPSIS AS INTRODUCED:

New Act

Creates the 72-Hour Budget Review Act. Prohibits a hearing or vote on any appropriation bill or revenue bill for at least 72 hours after the bill is made publicly available. Provides that a vote on an amendment to an appropriation bill or a revenue bill is not in order unless that amendment is made publicly available within a specified period prior to the vote. Provides that these temporal limitations may be waived by an affirmative two-thirds vote of the full committee or house considering the legislation. Effective immediately.

A BILL FOR

AN ACT concerning State government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the 72-Hour Budget Review Act.

Section 5. Definitions. As used in this Act:

"Amendment" means any proposed change to a bill.

"Appropriation bill" means any bill authorizing an appropriation of funds for State operating, capital, or transportation expenses.

"Publicly available" means available for viewing on the General Assembly's website and published in a bill report, committee report, or conference committee report.

"Revenue bill" means any bill that raises revenue for operating, capital, or transportation expenses.

"Striking amendment" means any amendment removing and replacing everything after the enacting clause of a bill.

Section 10. Hearing or votes prohibited for 72 hours. A hearing or vote on any appropriation bill or revenue bill is prohibited for at least 72 hours after the bill is made publicly available. This 72-hour period excludes Saturdays, Sundays, and holidays unless the house considering the bill is in session on that day.

Section 15. Adoption of amendments and striking amendments.

(a) A vote on an amendment to an appropriation bill or a revenue bill, other than a striking amendment, is not in order unless that amendment is made publicly available at least 24 hours prior to the vote. This 24-hour period excludes Saturdays, Sundays, and holidays unless the house considering the bill is in session on that day.

(b) A vote on a striking amendment to an appropriation bill or a revenue bill is not in order unless that amendment is made publicly available at least 48 hours prior to the vote. This 48-hour period excludes Saturdays, Sundays, and holidays unless the house considering the bill is in session on that day.

Section 20. Application to multiple stages of consideration. The time limitations in this Act apply each time a new version of an appropriation bill or a revenue bill is considered. This includes consideration of conference committee recommendations.

Section 25. Exceptions. The time limitation of this Act may be waived by an affirmative two-thirds vote of the full committee or house considering the legislation. For any such legislation, the following statement with respect to the legislation must be included in any bill report and on the General Assembly's website:

"The (insert the house or committee) has waived the People's right for a detailed review of this legislation, as required under the 72-Hour Budget Review Act.".

Section 99. Effective date. This Act takes effect upon becoming law.
