Amends the Counties Code and the Illinois Municipal Code. Provides that a county or municipality may not adopt any regulation that prohibits or has the effect of prohibiting the use of natural gas in new construction without a referendum. Limits the concurrent exercise of home rule powers.

A BILL FOR

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Counties Code is amended by adding Section 5-1195 as follows:

(55 ILCS 5/5-1195 new)

Sec. 5-1195. Prohibiting the use of natural gas in new construction. Notwithstanding any other provision of law, a county may not adopt any regulation that prohibits or has the effect of prohibiting the use of natural gas in new construction without a referendum. A home rule county may not regulate natural gas in a manner inconsistent with this Section. This Section is a limitation under subsection (i) of Section 6 of Article VII of the Illinois Constitution on the concurrent exercise by home rule units of powers and functions exercised by the State.

Section 10. The Illinois Municipal Code is amended by adding Section 11-30-11 as follows:

This Section is a limitation under subsection (i) of Section 6 of Article VII of the Illinois Constitution on the concurrent exercise by home rule units of powers and functions exercised by the State.
