SYNOPSIS AS INTRODUCED:

415 ILCS 60/14.5 new

Amends the Illinois Pesticide Act. Provides that, except as expressly authorized under specific provisions of the Act, no person shall distribute, sell, offer for sale, or use in the State any herbicide product containing paraquat dichloride or any other chemical form of paraquat. Requires all persons that use, distribute, or sell paraquat in this State to report certain information to the Department of Agriculture. Directs the Department of Agriculture to adopt any rules necessary to implement and administer these provisions. Effective immediately.

A BILL FOR

AN ACT concerning safety.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Pesticide Act is amended by adding Section 14.5 as follows:

(415 ILCS 60/14.5 new)

Sec. 14.5. Paraquat ban.

(a) As used in this Section:

"Department" means the Department of Agriculture.

"Paraquat" means any herbicide product containing paraquat dichloride or any other chemical form of paraquat.

"Person" means any individual, firm, entity, partnership, exchange, association, trustee, receiver, corporation, or any other business organization or any member, officer, or employee of such a business organization.

"Use" means the application, distribution, sale, or handling of paraquat within this State.

(b) Beginning January 1, 2027, except as provided under subsections 4 and 5 of Section 14, the use of paraquat is prohibited in this State.

(c) The Department, in consultation with the Department of Natural Resources and the Department of Public Health, may, by rule, allow the limited use of Paraquat for research purposes only when such research is conducted under strict safety and reporting protocols established by the Department.

(d) By January 1, 2027, all persons that use, distribute, or sell paraquat in this State shall submit a detailed report or reports to the Department, including, but not limited to, the following information:

(1) the quantity of paraquat used, sold, or distributed in the preceding year;

(2) the geographic areas where paraquat is used;

(3) the types of crops or applications for which paraquat is used; and

(4) any other information that the Department shall require by rule or regulation.

(e) Any person who violates the provisions of subsection (d) of this Section is subject to penalties as provided in Section 24.

(f) The Department shall adopt any rules necessary to implement and administer this Section, including, but not limited to, rules establishing fines and penalties.

Section 99. Effective date. This Act takes effect upon becoming law.
