SYNOPSIS AS INTRODUCED:

New Act

Creates the Rental Age Protection Act. Provides that it is unlawful for an automobile rental company to refuse to rent a motor vehicle to any person 18 years of age or older on the basis of age if insurance coverage for a person of that age is available. Provides that an automobile rental company may not charge a person any extra costs for insurance based solely on the age of the person renting the motor vehicle. Provides that it is unlawful for a lodging establishment to refuse to rent a room to any person 18 years of age or older on the basis of age or charge a person a higher rate than the regular rate charged to rent a room on the basis of age. Provides that a violation of any of the provisions of the Act is an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. Defines terms. Amends the Renter's Financial Responsibility and Protection Act to remove provisions concerning minimum age requirements. Amends the Consumer Fraud and Deceptive Business Practices Act to make a conforming change.

A BILL FOR

AN ACT concerning business.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Rental Age Protection Act.

Section 5. Definitions. As used in this Act:

"Automobile rental company" means a person or entity whose primary business is renting motor vehicles to the public for 30 days or less.

"Lodging establishment" means any building or buildings maintained, advertised, and held out to the public to be a place where lodging is offered for consideration to travelers and guests. "Lodging establishment" includes hotels, inns, motels, tourist homes or courts, and lodging houses.

"Motor vehicle" means a motor vehicle as defined in the Illinois Vehicle Code that a person with a Class D driver's license may operate.

"Person" means a natural person, corporation, partnership, trust, or other entity, and in the case of an entity, it shall include any other entity in which it has a majority interest or which it effectively controls as well as the individual officers, directors, and other persons in active control of the activities of each such entity.

Section 10. Automobile rental companies. It is unlawful for an automobile rental company to refuse to rent a motor vehicle to any person 18 years of age or older on the basis of age if insurance coverage for a person of that age is available. An automobile rental company may not charge a person any extra costs for insurance based solely on the age of the person renting the motor vehicle. Nothing in this Section prohibits an automobile rental company from requiring a person to provide documentation confirming the age of that person before entering into a rental agreement.

Section 15. Lodging establishments. It is unlawful for a lodging establishment to refuse to rent a room to any person 18 years of age or older on the basis of age or charge a person a higher rate than the regular rate charged to rent a room on the basis of age. Nothing in this Section prohibits a lodging establishment from requiring a person to provide documentation confirming the age of that person before entering into a rental agreement.

Section 20. Enforcement by Attorney General. A violation of any of the provisions of this Act is an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. All remedies, penalties, and authority granted to the Attorney General by that Act shall be available to him or her for the enforcement of this Act.

Section 90. The Renter's Financial Responsibility and Protection Act is amended by changing Section 10 as follows:

Sec. 10. Definitions. As used in this Act:

"Rental Company" means a person or entity that rents private passenger vehicles to the public for 30 days or less.

"Renter" means a person or entity that obtains the use of a private passenger vehicle from a rental company under terms of a rental agreement.

"Rental Agreement" means an agreement for 30 days or less setting forth the terms and conditions governing the use of a private passenger vehicle provided by a rental company.

"Authorized Driver" means: the renter; the renter's spouse if the spouse is a licensed driver and satisfies the rental company's minimum age requirement; the renter's employer, employee, or co-worker if that person is a licensed driver, satisfies the rental company's minimum age requirement, and at the time of the rental is engaged in a business activity with the renter; any person who is expressly listed by the rental company on the rental agreement as an authorized driver; and any person driving directly to a medical or police facility under circumstances reasonably believed to constitute an emergency and who is a licensed driver.

"Damage Waiver" means a rental company's agreement not to hold an authorized driver liable for all or a part of any damage to or loss of a rented vehicle for which the renter may be liable pursuant to Section 6-305.2. "Damage Waiver" shall encompass within its meaning other similar terms used by rental companies, such as "Collision Damage Waiver", "Loss Damage Waiver", "Physical Damage Waiver", and the like.

Section 95. The Consumer Fraud and Deceptive Business Practices Act is amended by adding Section 2HHHH as follows:

Sec. 2HHHH. Violations of the Rental Age Protection Act. A person who violates the Rental Age Protection Act commits an unlawful practice within the meaning of this Act.
