SYNOPSIS AS INTRODUCED:
 
5 ILCS 100/5-45.65 new
210 ILCS 47/3-217 new

    Amends the ID/DD Community Care Act. Provides that, by no later than January 1, 2026, the Department of Public Health shall adopt and implement streamlined and person-centered procedures for appealing a resident assessment conducted by the inspection of care team. Requires the Department to adopt rules, including emergency rules, to implement the provisions. Amends the Illinois Administrative Procedure Act to make a conforming change. Effective July 1, 2025.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 3. The Illinois Administrative Procedure Act is
5amended by adding Section 5-45.65 as follows:
 
6    (5 ILCS 100/5-45.65 new)
7    Sec. 5-45.65. Emergency rulemaking; ID/DD facility rate
8reviews. To provide for the expeditious and timely
9implementation of Section 3-217 of the ID/DD Community Care
10Act, emergency rules implementing Section 3-217 of the ID/DD
11Community Care Act may be adopted in accordance with Section
125-45 by the Department of Public Health. The adoption of
13emergency rules authorized by Section 5-45 and this Section is
14deemed to be necessary for the public interest, safety, and
15welfare.
16    This Section is repealed one year after the effective date
17of this amendatory Act of the 104th General Assembly.
 
18    Section 5. The ID/DD Community Care Act is amended by
19adding Section 3-217 as follows:

21    Sec. 3-217. Facility rate review procedures.

1    (a) No later than January 1, 2026, for facilities licensed
2by the Department under this Act, the Department shall adopt
3and implement streamlined and person-centered procedures for
4appealing a resident assessment conducted by the inspection of
5care team.
6    (b) The Department shall adopt rules, including emergency
7rules as authorized by Section 5-45 of the Illinois
8Administrative Procedure Act, to implement the provisions of
9this Section.
 
10    Section 99. Effective date. This Act takes effect July 1,
112025.
