| 1 | AN ACT concerning criminal law. | ||||||
| 2 | Be it enacted by the People of the State of Illinois, | ||||||
| 3 | represented in the General Assembly: | ||||||
| 4 | Section 5. The Unified Code of Corrections is amended by | ||||||
| 5 | adding Section 3-15-5 as follows: | ||||||
| 6 | (730 ILCS 5/3-15-5 new) | ||||||
| 7 | Sec. 3-15-5. Task force on ADA requirements in | ||||||
| 8 | correctional institutions and facilities. | ||||||
| 9 | (a) The Department of Corrections shall convene a special | ||||||
| 10 | task force to study and propose recommendations regarding ADA | ||||||
| 11 | requirements in correctional institutions and facilities for | ||||||
| 12 | aging committed persons with life sentences. The task force | ||||||
| 13 | shall be composed of no more than 22 members appointed by the | ||||||
| 14 | Director of Corrections as follows: | ||||||
| 15 | (1) not more than 4 members representing county jails; | ||||||
| 16 | (2) not more than 8 members representing community | ||||||
| 17 | health service providers who provide care and assistance | ||||||
| 18 | to individuals with disabilities; | ||||||
| 19 | (3) three members of the general public, at least one | ||||||
| 20 | of whom must be living with a disability; | ||||||
| 21 | (4) not more than 3 representatives from organizations | ||||||
| 22 | that work to ensure that people with disabilities have | ||||||
| 23 | equal rights and opportunities; and | ||||||

| 1 | (5) not more than 4 members representing the | ||||||
| 2 | Department of Corrections. | ||||||
| 3 | The Director of Corrections shall, in appointing the task | ||||||
| 4 | force, attempt to ensure that the membership on the task force | ||||||
| 5 | represents the geographic diversity of the State. | ||||||
| 6 | (b) The members of the task force shall serve without | ||||||
| 7 | compensation and may not receive reimbursement for any | ||||||
| 8 | expenses incurred in performing their duties as members of the | ||||||
| 9 | task force. | ||||||
| 10 | (c) The task force shall study and make recommendations | ||||||
| 11 | regarding the following topics: | ||||||
| 12 | (1) the number of individuals in correctional | ||||||
| 13 | institutions and facilities who have disabilities, | ||||||
| 14 | including sight, hearing, and mobility issues; | ||||||
| 15 | (2) how the population in paragraph (1) are being | ||||||
| 16 | accommodated; | ||||||
| 17 | (3) how many committed persons are not having their | ||||||
| 18 | needs met; and | ||||||
| 19 | (4) what areas, as it relates to ADA accessibility, | ||||||
| 20 | correctional institutions and facilities that are unable | ||||||
| 21 | to provide adequate accommodations and care for aging | ||||||
| 22 | committed persons with disabilities. | ||||||
| 23 | (d) The task force must submit its recommendations as to | ||||||
| 24 | any changes in the ADA standards for correctional institutions | ||||||
| 25 | and facilities to the General Assembly on or before July 1, | ||||||
| 26 | 2026. | ||||||
