SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2HHHH new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice for a retail establishment to not accept the return of a product by a consumer or only offer store credit to the consumer in exchange for the return of a product if the consumer purchased the product at that retail establishment and the product is unopened and unused.

1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Consumer Fraud and Deceptive Business
5Practices Act is amended by adding Section 2HHHH as follows:
 
6    (815 ILCS 505/2HHHH new)
7    Sec. 2HHHH. Return of products sold at retail
8establishments.
9    (a) As used in this Section, "retail establishment" means
10a place of business in this State that is open to the general
11public for the sale of consumer products.
12    (b) It is an unlawful practice within the meaning of this
13Act for a retail establishment to not accept the return of a
14product by a consumer or only offer store credit to the
15consumer in exchange for the return of a product if the
16consumer purchased the product at that retail establishment
17and the product is unopened and unused.
