| 1 | AN ACT concerning transportation. | |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||
| 4 | Section 1. Short title. This Act may be cited as the | |||||||||||||||||||
| 5 | Emergency Digital Communication Pilot Permits Act. | |||||||||||||||||||
| 6 | Section 5. Purpose. The purpose of this Act is to | |||||||||||||||||||
| 7 | authorize municipalities in this State to install and operate | |||||||||||||||||||
| 8 | noncommercial digital banner systems within State highway | |||||||||||||||||||
| 9 | rights-of-way for the purpose of enhancing homeland security, | |||||||||||||||||||
| 10 | emergency preparedness, and public safety communications. | |||||||||||||||||||
| 11 | Section 10. Definition. As used in this Act, "digital | |||||||||||||||||||
| 12 | public safety communication device" means a digital or LED | |||||||||||||||||||
| 13 | display installed by or on behalf of a local governmental | |||||||||||||||||||
| 14 | entity, used exclusively for emergency alerts, public safety | |||||||||||||||||||
| 15 | messaging, and civic announcements. | |||||||||||||||||||
| 16 | Section 15. Permitting. Notwithstanding any provision in | |||||||||||||||||||
| 17 | Section 6.02 of the Highway Advertising Control Act of 1971 or | |||||||||||||||||||
| 18 | Section 9-112.2 of the Illinois Highway Code to the contrary, | |||||||||||||||||||
| 19 | the Department of Transportation may issue pilot permits for | |||||||||||||||||||
| 20 | digital public safety communication devices on State highway | |||||||||||||||||||
| 21 | rights-of-way, subject to regulatory guidelines developed by | |||||||||||||||||||
| |||||||
| |||||||
| 1 | the Department of Transportation. | ||||||
| 2 | Section 20. Restrictions. Digital public safety | ||||||
| 3 | communication devices shall be operated solely by a unit of | ||||||
| 4 | local government, shall not display commercial advertising, | ||||||
| 5 | and must be installed on municipally owned infrastructure with | ||||||
| 6 | emergency override functionality. | ||||||
| 7 | Section 25. Rulemaking. The Department of Transportation | ||||||
| 8 | shall adopt rules for implementation of this Act, including | ||||||
| 9 | eligibility, content restrictions, monitoring, and enforcement | ||||||
| 10 | mechanisms. | ||||||
| 11 | Section 99. Effective date. This Act takes effect upon | ||||||
| 12 | becoming law. | ||||||
