| 1 | AN ACT concerning criminal law. | |||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||||
| 4 | Section 5. The State Finance Act is amended by adding | |||||||||||||||||||||
| 5 | Section 5.1030 as follows: | |||||||||||||||||||||
| 6 | (30 ILCS 105/5.1030 new) | |||||||||||||||||||||
| 7 | Sec. 5.1030. The Immigrant Family Services Fund. | |||||||||||||||||||||
| 8 | Section 10. The Criminal Code of 2012 is amended by adding | |||||||||||||||||||||
| 9 | Section 33-10 as follows: | |||||||||||||||||||||
| 10 | (720 ILCS 5/33-10 new) | |||||||||||||||||||||
| 11 | Sec. 33-10. Law enforcement; use of masks. | |||||||||||||||||||||
| 12 | (a) In this Section: | |||||||||||||||||||||
| 13 | "Law enforcement officer" means any officer of a local, | |||||||||||||||||||||
| 14 | State, or federal law enforcement agency, or any person acting | |||||||||||||||||||||
| 15 | on behalf of a local, State, or federal law enforcement | |||||||||||||||||||||
| 16 | agency. A person acts on behalf of a local, State, or federal | |||||||||||||||||||||
| 17 | law enforcement agency when the person is summoned or directed | |||||||||||||||||||||
| 18 | by a law enforcement officer of a local, State, or federal law | |||||||||||||||||||||
| 19 | enforcement agency to assist the law enforcement officer in | |||||||||||||||||||||
| 20 | the execution of the officer's duties. | |||||||||||||||||||||
| 21 | "Mask" does not include a face shield if it does not | |||||||||||||||||||||
| |||||||
| |||||||
| 1 | conceal the wearer's face. "Mask" does not include a clear | ||||||
| 2 | mask that does not conceal the wearer's face. | ||||||
| 3 | (b) A law enforcement officer shall not wear any mask or | ||||||
| 4 | neck gaiter while interacting with the public in the | ||||||
| 5 | performance of the law enforcement officer's duties, except | ||||||
| 6 | for medical grade masks that are surgical or N95 respirators | ||||||
| 7 | designed to prevent the transmission of airborne diseases and | ||||||
| 8 | diseases, masks designed to protect against exposure to smoke | ||||||
| 9 | during a state of emergency related to wildfires or protective | ||||||
| 10 | gear used by Special Weapons and Tactics (SWAT) team officers | ||||||
| 11 | necessary to protect their faces from harm while they perform | ||||||
| 12 | their SWAT responsibilities. | ||||||
| 13 | (c) While executing law enforcement duties, a law | ||||||
| 14 | enforcement officer shall display on the uniform that the | ||||||
| 15 | officer wears: (i) the officer's name or badge number and (ii) | ||||||
| 16 | the agency in which the officer is employed. | ||||||
| 17 | (d) This Section does not apply to an officer while the | ||||||
| 18 | officer is engaged in an undercover assignment. | ||||||
| 19 | (e)(1) A violation of this Section by any person acting on | ||||||
| 20 | behalf of a local, State, or federal law enforcement agency, | ||||||
| 21 | who is not a sworn peace officer or agent, is a Class A | ||||||
| 22 | misdemeanor. | ||||||
| 23 | (2) A violation of this Section by a sworn peace officer of | ||||||
| 24 | a local, State, or federal law enforcement agency, or an agent | ||||||
| 25 | of a State, local, or federal law enforcement agency, is a | ||||||
| 26 | petty offense. A second or subsequent violation is a Class A | ||||||
| |||||||

| 1 | misdemeanor. | ||||||
| 2 | (3) A violation of both subsections (b) and (c) committed | ||||||
| 3 | during a single act only constitutes one violation of this | ||||||
| 4 | Section. | ||||||
| 5 | (4) Moneys from fines received for convictions under this | ||||||
| 6 | Section shall be deposited into a special fund in the State | ||||||
| 7 | treasury to be known as the Immigrant Family Services Fund and | ||||||
| 8 | shall be used by the Department of Human Services to provide | ||||||
| 9 | immigrant family services as determined by the Secretary of | ||||||
| 10 | Human Services. | ||||||
