    Amends the Counties Code and the Illinois Municipal Code. Provides that a county or a municipality may not adopt any ordinance or resolution or exercise any power that prohibits or has the effect of prohibiting the installation of a solar energy system. Limits home rule powers.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
55-12024 as follows:
 
6    (55 ILCS 5/5-12024 new)
7    Sec. 5-12024. Solar energy systems.
8    (a) For the purposes of this Section, "solar energy
9system" has the meaning given to that term in the Homeowners'
10Energy Policy Statement Act.
11    (b) Notwithstanding any provision of this Code or other
12provision of law, a county may not adopt any ordinance or
13resolution or exercise any power that prohibits or has the
14effect of prohibiting the installation of a solar energy
15system.
16    (c) A home rule unit may not regulate a solar energy system
17in a manner inconsistent with this Section. This Section is a
18limitation under subsection (i) of Section 6 of Article VII of
19the Illinois Constitution on the concurrent exercise by home
20rule units of powers and functions exercised by the State.
 
21    Section 10. The Illinois Municipal Code is amended by
22adding Section 11-13-30 as follows:
