Amends the Counties Code and the Illinois Municipal Code. Provides that a county or a municipality may not adopt any ordinance or resolution or exercise any power that prohibits or has the effect of prohibiting the installation of a solar energy system. Limits home rule powers.

A BILL FOR

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Counties Code is amended by adding Section 5-12024 as follows:

(55 ILCS 5/5-12024 new)

Sec. 5-12024. Solar energy systems.

(a) For the purposes of this Section, "solar energy system" has the meaning given to that term in the Homeowners' Energy Policy Statement Act.

(b) Notwithstanding any provision of this Code or other provision of law, a county may not adopt any ordinance or resolution or exercise any power that prohibits or has the effect of prohibiting the installation of a solar energy system.

(c) A home rule unit may not regulate a solar energy system in a manner inconsistent with this Section. This Section is a limitation under subsection (i) of Section 6 of Article VII of the Illinois Constitution on the concurrent exercise by home rule units of powers and functions exercised by the State.

Section 10. The Illinois Municipal Code is amended by adding Section 11-13-30 as follows:
