SYNOPSIS AS INTRODUCED:

815 ILCS 505/2MMMM new

Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that a facility or health care professional that offers telehealth services shall not bill or charge a person, group or individual policy of accident and health insurance, or managed care plan for any services or care not rendered during a telehealth visit, including, but not limited to, exams that are not possible to perform on a patient at a remote location. Provides that a violation of the provision is an unlawful practice within the meaning of the Act.

A BILL FOR

AN ACT concerning business.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Consumer Fraud and Deceptive Business Practices Act is amended by adding Section 2MMMM as follows:

Sec. 2MMMM. Telehealth billing transparency.

(a) For the purpose of this Section, "facility", "health care professional", and "telehealth services" have the meanings set forth in Section 5 of the Telehealth Act.

(b) A facility or health care professional that offers telehealth services shall not bill or charge a person, group or individual policy of accident and health insurance, or managed care plan for any services or care not rendered during a telehealth visit, including, but not limited to, exams that are not possible to perform on a patient at a remote location, such as taking measurements of a patient's blood pressure, temperature, height, or weight.

(c) A violation of this Section is an unlawful practice within the meaning of this Act.
