| 1 | HOUSE JOINT RESOLUTION | ||||||
| 2 | WHEREAS, Community Integrated Living Arrangements (CILAs), | ||||||
| 3 | or group homes, provide community-based housing and essential | ||||||
| 4 | support for nearly 10,336 adults with intellectual and | ||||||
| 5 | developmental disabilities (I/DD) across Illinois, many of | ||||||
| 6 | whom require extensive supervision and care; and | ||||||
| 7 | WHEREAS, The State of Illinois is under the Ligas Consent | ||||||
| 8 | Decree, requiring expanded access to community-based services | ||||||
| 9 | for individuals with I/DD, and has repeatedly been found out | ||||||
| 10 | of compliance; and | ||||||
| 11 | WHEREAS, The Illinois Department of Human | ||||||
| 12 | Services-Division of Developmental Disabilities (DHS-DDD) | ||||||
| 13 | Guidehouse Rate Study, published in 2020, outlined several | ||||||
| 14 | I/DD rate changes based on approved recommendations by the | ||||||
| 15 | Ligas Rates Oversight Committee; from 2021 to 2025, DHS has | ||||||
| 16 | implemented portions of the rate study, and the General | ||||||
| 17 | Assembly has made significant investments into the I/DD | ||||||
| 18 | community system; and | ||||||
| 19 | WHEREAS, Beginning January 1, 2026, the final FY26 budget | ||||||
| 20 | for the State of Illinois eliminates $11.2 million in funding | ||||||
| 21 | for CILA providers, reducing services for all 24-hour CILA | ||||||
| 22 | residents, thereby threatening care quality and compliance | ||||||

| |||||||
| 1 | with federal home and community-based services regulations; | ||||||
| 2 | and | ||||||
| 3 | WHEREAS, Removing this funding from the I/DD system is a | ||||||
| 4 | piecemeal approach that does not consider the wholistic | ||||||
| 5 | funding needs presented in the DHS-DDD Guidehouse Rate Study | ||||||
| 6 | that exist as result of the Ligas Consent Decree; and | ||||||
| 7 | WHEREAS, Cuts to CILA Direct Support Professional (DSP) | ||||||
| 8 | service hours will result in reductions in services for people | ||||||
| 9 | with I/DD, particularly those with the most intense needs, | ||||||
| 10 | resulting in high levels of system destabilization and service | ||||||
| 11 | degradation over the long term; and | ||||||
| 12 | WHEREAS, Some crucial priorities contained within the | ||||||
| 13 | DHS-DDD Guidehouse Rate Study remain fully unfunded such as | ||||||
| 14 | the "Zero Hour" Staffing Model, which funds staff for 24 hours | ||||||
| 15 | a day, seven days a week and would add 2.4 million DSP service | ||||||
| 16 | hours into the system; and | ||||||
| 17 | WHEREAS, Removing CILA DSP Service hours from the State's | ||||||
| 18 | I/DD system as is contained within the FY26 final budget, only | ||||||
| 19 | to reinsert CILA DSP Service Hours associated with | ||||||
| 20 | implementation of the "Zero Hour" Staffing Model at a future | ||||||
| 21 | date, is budgetarily inefficient and unhealthy for system | ||||||
| 22 | stability; and | ||||||

| 1 | WHEREAS, Significant cuts to Medicaid and other federal | ||||||
| 2 | programs that provide care to thousands in Illinois in the | ||||||
| 3 | I/DD community have created great uncertainty for individuals, | ||||||
| 4 | families, providers, lawmakers, and advocates, and more time | ||||||
| 5 | is needed to fully understand and plan for those impacts on | ||||||
| 6 | I/DD services; therefore, be it | ||||||
| 7 | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE | ||||||
| 8 | HUNDRED FOURTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE | ||||||
| 9 | SENATE CONCURRING HEREIN, that we urge the Illinois Department | ||||||
| 10 | of Human Services and the Pritzker Administration to delay | ||||||
| 11 | cuts to Direct Service Professional (DSP) service hours set to | ||||||
| 12 | begin January 1,2026, until such time as the State is prepared | ||||||
| 13 | to implement the "Zero Hour" Staffing Model, to protect the | ||||||
| 14 | services depended on by individuals with intellectual and | ||||||
| 15 | developmental disabilities (I/DD); and be it further | ||||||
| 16 | RESOLVED, That suitable copies of this resolution be | ||||||
| 17 | delivered to the Governor, the Speaker and Minority Leader of | ||||||
| 18 | the Illinois House of Representatives, the President and | ||||||
| 19 | Minority Leader of the Illinois Senate, and the Illinois | ||||||
| 20 | Department of Human Services-Division of Developmental | ||||||
| 21 | Disabilities. | ||||||
