| 1 | AN ACT concerning civil law. | |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||
| 4 | Section 1. Short title. This Act may be cited as the ICE | |||||||||||||||||||
| 5 | and CBP Tracker Act. | |||||||||||||||||||
| 6 | Section 5. Legislative intent. The General Assembly makes | |||||||||||||||||||
| 7 | the following findings: | |||||||||||||||||||
| 8 | (1) Federal law enforcement officers are using tear | |||||||||||||||||||
| 9 | gas and firing projectiles against peaceful protesters, | |||||||||||||||||||
| 10 | legal observers, volunteer street medics, and journalists | |||||||||||||||||||
| 11 | outside U.S. Immigration and Customs Enforcement detention | |||||||||||||||||||
| 12 | facilities in Illinois in excess of the force necessary to | |||||||||||||||||||
| 13 | control a crowd or for agents to fulfill their duties. | |||||||||||||||||||
| 14 | (2) All law enforcement officers have a duty to uphold | |||||||||||||||||||
| 15 | the United States Constitution and Illinois Constitution | |||||||||||||||||||
| 16 | and protect the due process rights of Illinois citizens. | |||||||||||||||||||
| 17 | (3) Therefore, it is essential for Illinois to protect | |||||||||||||||||||
| 18 | and prevent the violation of civil rights of its citizens | |||||||||||||||||||
| 19 | through a tracking system when rights are violated by | |||||||||||||||||||
| 20 | federal law enforcement officers. This is necessary to | |||||||||||||||||||
| 21 | promote transparency and hold law enforcement accountable | |||||||||||||||||||
| 22 | for their actions. | |||||||||||||||||||

| |||||||
| 1 | Section 10. Definitions. As used in this Act: | ||||||
| 2 | "CPB" means U.S. Customs and Border Protection. | ||||||
| 3 | "ICE" means U.S. Immigration and Customs Enforcement. | ||||||
| 4 | Section 15. Tracking system. | ||||||
| 5 | (a) The Attorney General must develop and maintain | ||||||
| 6 | Tracker, which is a statewide incident reporting system | ||||||
| 7 | related to unlawful activity in Illinois by personnel employed | ||||||
| 8 | by ICE personnel and CPB personnel, to receive, collect, and | ||||||
| 9 | verify any reports of misconduct, wrongful detentions, and | ||||||
| 10 | civil right abuses by ICE or CBP personnel occurring in | ||||||
| 11 | Illinois. | ||||||
| 12 | (b) The reporting system must be available for the public | ||||||
| 13 | to submit a complaint via a public website. The report may | ||||||
| 14 | include the following: | ||||||
| 15 | (1) the name, address, contact information, and | ||||||
| 16 | attorney or representative of the person who files a | ||||||
| 17 | report; | ||||||
| 18 | (2) the details of the incident, such as location, | ||||||
| 19 | description of event, date and time, and any photos or | ||||||
| 20 | videos; | ||||||
| 21 | (3) whether legal action or an administrative | ||||||
| 22 | complaint about the incident has been commenced or filed; | ||||||
| 23 | and | ||||||
| 24 | (4) the reporting person's signature that the report | ||||||
| 25 | is true and accurate to the best of the reporter's | ||||||
| |||||||
| |||||||
| 1 | knowledge and belief and any documents attached are true | ||||||
| 2 | and accurate copies of the original. | ||||||
| 3 | Section 20. Duties of the Attorney General. The Attorney | ||||||
| 4 | General must do the following: | ||||||
| 5 | (1) create a system to verify received reports from | ||||||
| 6 | the public before publishing; | ||||||
| 7 | (2) regularly publish on its public website verified | ||||||
| 8 | reports; | ||||||
| 9 | (3) work with local, State, and federal law | ||||||
| 10 | enforcement agencies to collect reports on misconduct, | ||||||
| 11 | wrongful detention, and civil rights abuses by ICE or CBP | ||||||
| 12 | personnel; and | ||||||
| 13 | (4) submit any verified report to the appropriate law | ||||||
| 14 | enforcement agency or to the violator's disciplinary | ||||||
| 15 | organization that includes: | ||||||
| 16 | (A) the substance of the violation; | ||||||
| 17 | (B) the name of the agency employing the violator; | ||||||
| 18 | (C) the current status of the complaint; | ||||||
| 19 | (D) redacting of any identifiable information of | ||||||
| 20 | the victim unless the victim consents otherwise; | ||||||
| 21 | (E) attaching any public documentation by local, | ||||||
| 22 | State, and Federal government agencies regarding ICE | ||||||
| 23 | or CBP personnel on misconduct, wrongful detention, | ||||||
| 24 | and civil rights abuses; and | ||||||
| 25 | (F) attach any public documents, photographs, or | ||||||
| |||||||
| |||||||
| 1 | videos. | ||||||
| 2 | Section 25. Rules. The Attorney General may adopt rules to | ||||||
| 3 | implement this Act. | ||||||
