| 1 | AN ACT concerning local government. | |||||||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||||||||
| 4 | Section 5. The Counties Code is amended by adding Section | |||||||||||||||||||||||||
| 5 | 5-1195 as follows: | |||||||||||||||||||||||||
| 6 | (55 ILCS 5/5-1195 new) | |||||||||||||||||||||||||
| 7 | Sec. 5-1195. Dissolution of townships with a population of | |||||||||||||||||||||||||
| 8 | less than 500. If a township dissolves as provided in Article | |||||||||||||||||||||||||
| 9 | 24.5 of the Township Code, the county containing the | |||||||||||||||||||||||||
| 10 | geographic boundaries of the dissolving township shall assume | |||||||||||||||||||||||||
| 11 | the powers, duties, and obligations of the dissolved township | |||||||||||||||||||||||||
| 12 | as provided in Article 24.5 of the Township Code, excluding | |||||||||||||||||||||||||
| 13 | those of the township's road district. | |||||||||||||||||||||||||
| 14 | Section 10. The Township Code is amended by adding Article | |||||||||||||||||||||||||
| 15 | 24.5 as follows: | |||||||||||||||||||||||||

| 1 | less than 500. All townships with a population less than 500 | ||||||
| 2 | are dissolved on January 1, 2029. | ||||||

| 4 | Sec. 24.5-10. Dissolution; transfer of rights and duties. | ||||||
| 5 | (a) When a township is dissolved under Section 24.5-5: | ||||||
| 6 | (1) On or before the date of dissolution, all real and | ||||||
| 7 | personal property, and any other assets, together with all | ||||||
| 8 | personnel, contractual obligations, and liabilities of the | ||||||
| 9 | dissolving township, excluding those of the township's | ||||||
| 10 | road district, wholly within the boundaries of the | ||||||
| 11 | dissolving township shall be transferred to the county | ||||||
| 12 | containing the geographic boundaries of the dissolving | ||||||
| 13 | township. All funds of the dissolved township shall be | ||||||
| 14 | used solely on behalf of the residents of the geographic | ||||||
| 15 | area within the boundaries of the dissolved township. | ||||||
| 16 | After the transfer of property to the county under | ||||||
| 17 | this paragraph, all park land, cemetery land, buildings, | ||||||
| 18 | and facilities within the geographic area of the | ||||||
| 19 | dissolving township must be used for the primary benefit | ||||||
| 20 | of the geographic area of the dissolving township. | ||||||
| 21 | Proceeds from the sale of the park land, cemetery land, | ||||||
| 22 | buildings, or facilities after transfer to the county must | ||||||
| 23 | be utilized for the sole benefit of the geographic area of | ||||||
| 24 | the dissolved township. | ||||||
| 25 | (2) On and after the date of dissolution, all rights | ||||||
| |||||||
| |||||||
| 1 | and duties of the dissolved township, excluding those of | ||||||
| 2 | the township's road district, may be exercised by the | ||||||
| 3 | county containing the geographic boundaries of the | ||||||
| 4 | dissolving township solely on behalf of the residents of | ||||||
| 5 | the geographic area within the boundaries of the dissolved | ||||||
| 6 | township. The duties that may be exercised by the county | ||||||
| 7 | include, but are not limited to, the administration of a | ||||||
| 8 | dissolved township's general assistance program, | ||||||
| 9 | maintenance and operation of a dissolved township's | ||||||
| 10 | cemeteries, and the chief county assessment officer of the | ||||||
| 11 | county containing the geographic boundaries of the | ||||||
| 12 | dissolving township exercising the duties of the township | ||||||
| 13 | assessor. | ||||||
| 14 | (3) The county board of the county containing the | ||||||
| 15 | geographic boundaries of the dissolving township shall not | ||||||
| 16 | extend a property tax levy that is greater than 25% of the | ||||||
| 17 | property tax levy extended by the dissolved township for | ||||||
| 18 | the duties taken on by the county containing the | ||||||
| 19 | geographic boundaries of the dissolving township. This | ||||||
| 20 | property tax levy may not be extended outside the | ||||||
| 21 | boundaries of the dissolved township. In all subsequent | ||||||
| 22 | years, this levy shall be bound by the provisions of the | ||||||
| 23 | Property Tax Extension Limitation Law. | ||||||
| 24 | A tax levy extended under this paragraph may be used | ||||||
| 25 | for the purposes allowed by the statute authorizing the | ||||||
| 26 | tax levy or to pay liabilities of the dissolved township | ||||||
| |||||||
| |||||||
| 1 | that were transferred to the county under paragraph (1). | ||||||
| 2 | The taxpayers within the boundaries of the dissolved | ||||||
| 3 | township are responsible to pay any liabilities | ||||||
| 4 | transferred to the county, and the county shall reduce | ||||||
| 5 | spending within the boundaries of the former township in | ||||||
| 6 | the amount necessary to pay off any liabilities | ||||||
| 7 | transferred to the county under paragraph (1) that are not | ||||||
| 8 | covered by the assets enumerated in paragraph (1) or taxes | ||||||
| 9 | under this paragraph. | ||||||
| 10 | (4) All road districts wholly within the boundaries of | ||||||
| 11 | the dissolving township and their highway commissioners | ||||||
| 12 | shall retain all the same powers and responsibilities of | ||||||
| 13 | each road district that were held prior to the dissolution | ||||||
| 14 | of the township. | ||||||
| 15 | (5) On the date of dissolution of the township, | ||||||
| 16 | elected and appointed township officers shall cease to | ||||||
| 17 | hold office. An elected or appointed township official | ||||||
| 18 | shall not be compensated for any other duties performed | ||||||
| 19 | after the dissolution of the township that they | ||||||
| 20 | represented. An elected township official shall not have | ||||||
| 21 | legal recourse relating to the ceasing of their elected or | ||||||
| 22 | appointed positions upon the ceasing of their positions. | ||||||
| 23 | (b) Following the dissolution of a township under this | ||||||
| 24 | Article, the highway commissioner of any remaining township | ||||||
| 25 | road district whose township has been dissolved shall comply | ||||||
| 26 | with subsection (b) of Section 6-501 of the Illinois Highway | ||||||
| |||||||
| |||||||
| 1 | Code. The highway commissioner shall, on or before the third | ||||||
| 2 | Tuesday in December of each year, determine and certify to the | ||||||
| 3 | county board the amount necessary to be raised by taxation for | ||||||
| 4 | road purposes and for salaries of elected road district | ||||||
| 5 | officials in the road district, unless the county board, in | ||||||
| 6 | consultation with the highway commissioner, has determined a | ||||||
| 7 | more appropriate date to determine and certify the amounts to | ||||||
| 8 | be raised for taxation for road purposes each year. | ||||||
| 9 | If any highway commissioner during the last year of his or | ||||||
| 10 | her term of office for any reason does not file the certificate | ||||||
| 11 | in the office of the county clerk, as required under the | ||||||
| 12 | Illinois Highway Code, in time for presentation at a regular | ||||||
| 13 | meeting of the county board, the clerk shall present in lieu | ||||||
| 14 | thereof a certificate equal in amount to that presented for | ||||||
| 15 | the preceding year. | ||||||
| 16 | In such a county, the certificate shall be filed in the | ||||||
| 17 | office of the county clerk and by that official presented to | ||||||
| 18 | the county board at the regular meeting for the consideration | ||||||
| 19 | of the board. If approved by the county board, the amount so | ||||||
| 20 | certified or approved by the county board shall be extended by | ||||||
| 21 | the county clerk as road taxes against the taxable property of | ||||||
| 22 | the district. | ||||||
| 23 | (b) Following the dissolution of a township under this | ||||||
| 24 | Article, the highway commissioner of any remaining township | ||||||
| 25 | road district whose township has been dissolved shall attend | ||||||
| 26 | at least one county board meeting each month, unless the | ||||||
| |||||||
| |||||||
| 1 | county board did not meet that month. | ||||||
| 2 | Section 99. Effective date. This Act takes effect upon | ||||||
| 3 | becoming law. | ||||||
