| 1 | AN ACT concerning regulation. | ||||||
| 2 | Be it enacted by the People of the State of Illinois, | ||||||
| 3 | represented in the General Assembly: | ||||||
| 4 | Section 5. The Nursing Home Care Act is amended by adding | ||||||
| 5 | Section 3-610.5 as follows: | ||||||
| 6 | (210 ILCS 45/3-610.5 new) | ||||||
| 7 | Sec. 3-610.5. Incident and accident reporting. | ||||||
| 8 | (a) Each facility shall notify the Department of any | ||||||
| 9 | incident or accident that results in serious physical harm or | ||||||
| 10 | injury to a resident or any situation in which a resident | ||||||
| 11 | requires immediate medical attention, including admission to a | ||||||
| 12 | hospital, as a direct result of an incident or accident. | ||||||
| 13 | Nothing in this Section precludes reporting of suspected or | ||||||
| 14 | alleged abuse or neglect that must be reported according to | ||||||
| 15 | the Abused and Neglected Long Term Care Facility Residents | ||||||
| 16 | Reporting Act. | ||||||
| 17 | (b) Each facility shall, by phone, by fax, or through the | ||||||
| 18 | Office of Health Care Regulation LLCS Portal, notify the | ||||||
| 19 | appropriate regional office of the Department within 24 hours | ||||||
| 20 | after each reportable incident or accident. The facility shall | ||||||
| 21 | send a narrative summary of each reportable incident or | ||||||
| 22 | accident to the Department within 5 business days after the | ||||||
| 23 | incident or accident. | ||||||
