HB2682 - 104th General Assembly

To the Honorable Members of

The Illinois House of Representatives,

104th General Assembly:

 

Today, at the request of the bill’s sponsors and its advocates, I veto House Bill 2682 of the 104th General Assembly.

 

Language identical to that of House Bill 2682 was also included in the Fiscal Year 2026 Budget Implementation Act, enacted on June 16 as Public Act 104-0002, effective, in pertinent part, on July 1, 2025. By operation of law, House Bill 2682 will have a January 1, 2026, effective date for its amendment of sections 4-12 and 4-22 of the Illinois Public Aid Code, while Public Act 104-0002 expressly provides for an effective date of July 1, 2025, for its amendment of the same statutory provisions. Pursuant to the enactment of Public Act 104-0002, the Department of Human Services has already begun implementation of the amendments made to the Public Aid Code. To avoid any confusion or dispute regarding when the Department’s authority and duties under the amendatory language become effective, I agree with the bill’s sponsors and its advocates that the best course of action is to veto House Bill 2682 and continue the implementation of the Public Aid Code amendments in accordance with Public Act 104-0002.

 

Therefore, pursuant to Section 9(b) of Article IV of the Illinois Constitution of 1970, I hereby return House Bill 2682, entitled “AN ACT concerning public aid,” with the foregoing objections, vetoed in its entirety.
