| 4 | | "Section 5. The Swimming Facility Act is amended by |
| 5 | | changing Section 13 as follows:
|

| 7 | | Sec. 13. Rules. The Department shall promulgate, publish, |
| 8 | | adopt and amend such rules as may be necessary for the proper |
| 9 | | enforcement of this Act, to protect the health and safety of |
| 10 | | the public using swimming facilities and their appurtenances, |
| 11 | | and may, when necessary, utilize the services of any other |
| 12 | | state agencies to assist in carrying out the purposes of this |
| 13 | | Act. These rules shall include but are not limited to design |
| 14 | | criteria for swimming facility areas and bather preparation |
| 15 | | facilities, standards relating to sanitation, cleanliness, |
| 16 | | plumbing, water supply, sewage and solid waste disposal, |

| 1 | | design and construction of all equipment, buildings, rodent |
| 2 | | and insect control, communicable disease control, safety and |
| 3 | | sanitation of appurtenant swimming facilities. The rules must |
| 4 | | include provisions for the prevention of bather entrapment or |
| 5 | | entanglement at new and existing swimming facilities. Bather |
| 6 | | preparation facilities consisting of dressing room space, |
| 7 | | toilets and showers shall be available for use of patrons of |
| 8 | | swimming facilities, except as provided by Department rules. |
| 9 | | Notwithstanding any other provision of law, the rules |
| 10 | | adopted by the Department shall permit sporting good equipment |
| 11 | | systems and fitness equipment systems to be installed in |
| 12 | | swimming facilities if the sporting good equipment system or |
| 13 | | fitness equipment system is designed for pool use and |
| 14 | | installed in accordance with the safe-use parameters specified |
| 15 | | by the manufacturer. Sporting good equipment systems and |
| 16 | | fitness equipment systems that meet these requirements shall |
| 17 | | not be considered an obstruction. This paragraph does not |
| 18 | | apply to school swimming facilities. |
