AMENDMENT TO SENATE BILL 711

2    AMENDMENT NO. ______. Amend Senate Bill 711 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Emergency Medical Services (EMS) Systems
5Act is amended by changing Sections 3.5, 3.50, 3.55, and 3.65
6and by adding Section 3.260 as follows:
 
7    (210 ILCS 50/3.5)
8    Sec. 3.5. Definitions. As used in this Act:
9    "Clinical observation" means the ongoing observation of a
10patient's medical or mental health condition by a licensed
11health care professional utilizing a medical skill set while
12continuing assessment and care.
13    "Department" means the Illinois Department of Public
14Health.
15    "Director" means the Director of the Illinois Department
16of Public Health.

1    "Emergency" means a medical condition of recent onset and
2severity that would lead a prudent layperson, possessing an
3average knowledge of medicine and health, to believe that
4urgent or unscheduled medical care is required.
5    "Emergency Medical Services personnel" or "EMS personnel"
6means persons licensed as an Emergency Medical Responder (EMR)
7(First Responder), Emergency Medical Dispatcher (EMD),
8Emergency Medical Technician (EMT), Emergency Medical
9Technician-Intermediate (EMT-I), Advanced Emergency Medical
10Technician (A-EMT), Paramedic (EMT-P), Emergency
11Communications Registered Nurse (ECRN), Pre-Hospital
12Registered Nurse (PHRN), Pre-Hospital Advanced Practice
13Registered Nurse (PHAPRN), or Pre-Hospital Physician Assistant
14(PHPA).
15    "Exclusive representative" has the same meaning as defined
16in Section 3 of the Illinois Public Labor Relations Act.
17    "Health care facility" means a hospital, nursing home,
18physician's office or other fixed location at which medical
19and health care services are performed. It does not include
20"pre-hospital emergency care settings" which utilize EMS
21personnel to render pre-hospital emergency care prior to the
22arrival of a transport vehicle, as defined in this Act.
23    "Hospital" has the meaning ascribed to that term in the
24Hospital Licensing Act.
25    "Labor organization" has the same meaning as defined in
26Section 3 of the Illinois Public Labor Relations Act.

1    "Medical monitoring" means the performance of medical
2tests and physical exams to evaluate an individual's ongoing
3exposure to a factor that could negatively impact that
4person's health. "Medical monitoring" includes close
5surveillance or supervision of patients liable to suffer
6deterioration in physical or mental health and checks of
7various parameters such as pulse rate, temperature,
8respiration rate, the condition of the pupils, the level of
9consciousness and awareness, the degree of appreciation of
10pain, and blood gas concentrations such as oxygen and carbon
11dioxide.
12    "NREMT" means the National Registry of Emergency Medical
13Technicians.
14    "Silver spanner program" means a program in which a member
15under a fire department's or fire protection district's
16collective bargaining agreement works on or at the EMS System
17under another fire department's or fire protection district's
18collective bargaining agreement and (i) the other fire
19department or fire protection district is not the member's
20full-time employer and (ii) any EMS services not included
21under the original fire department's or fire protection
22district's collective bargaining agreement are included in the
23other fire department's or fire protection district's
24collective bargaining agreement.
25    "Trauma" means any significant injury which involves
26single or multiple organ systems.

2    (210 ILCS 50/3.50)
3    Sec. 3.50. Emergency Medical Services personnel licensure
4levels.
5    (a) "Emergency Medical Technician" or "EMT" means a person
6who has successfully completed a course in basic life support
7as approved by the Department, is currently licensed by the
8Department in accordance with standards prescribed by this Act
9and rules adopted by the Department pursuant to this Act, and
10practices within an EMS System. A valid Emergency Medical
11Technician-Basic (EMT-B) license issued under this Act shall
12continue to be valid and shall be recognized as an Emergency
13Medical Technician (EMT) license until the Emergency Medical
14Technician-Basic (EMT-B) license expires.
15    (b) "Emergency Medical Technician-Intermediate" or "EMT-I"
16means a person who has successfully completed a course in
17intermediate life support as approved by the Department, is
18currently licensed by the Department in accordance with
19standards prescribed by this Act and rules adopted by the
20Department pursuant to this Act, and practices within an
21Intermediate or Advanced Life Support EMS System.
22    (b-5) "Advanced Emergency Medical Technician" or "A-EMT"
23means a person who has successfully completed a course in
24basic and limited advanced emergency medical care as approved
25by the Department, is currently licensed by the Department in

1accordance with standards prescribed by this Act and rules
2adopted by the Department pursuant to this Act, and practices
3within an Intermediate or Advanced Life Support EMS System.
4    (c) "Paramedic (EMT-P)" means a person who has
5successfully completed a course in advanced life support care
6as approved by the Department, is licensed by the Department
7in accordance with standards prescribed by this Act and rules
8adopted by the Department pursuant to this Act, and practices
9within an Advanced Life Support EMS System. A valid Emergency
10Medical Technician-Paramedic (EMT-P) license issued under this
11Act shall continue to be valid and shall be recognized as a
12Paramedic license until the Emergency Medical
13Technician-Paramedic (EMT-P) license expires.
14    (c-5) "Emergency Medical Responder" or "EMR (First
15Responder)" means a person who has successfully completed a
16course in emergency medical response as approved by the
17Department and provides emergency medical response services in
18accordance with the level of care established by the National
19EMS Educational Standards Emergency Medical Responder course
20as modified by the Department, or who provides services as
21part of an EMS System response plan, as approved by the
22Department, of that EMS System. The Department shall have the
23authority to adopt rules governing the curriculum, practice,
24and necessary equipment applicable to Emergency Medical
25Responders.
26    On August 15, 2014 (the effective date of Public Act

198-973), a person who is licensed by the Department as a First
2Responder and has completed a Department-approved course in
3first responder defibrillator training based on, or equivalent
4to, the National EMS Educational Standards or other standards
5previously recognized by the Department shall be eligible for
6licensure as an Emergency Medical Responder upon meeting the
7licensure requirements and submitting an application to the
8Department. A valid First Responder license issued under this
9Act shall continue to be valid and shall be recognized as an
10Emergency Medical Responder license until the First Responder
11license expires.
12    (c-10) All EMS Systems and licensees shall be fully
13compliant with the National EMS Education Standards, as
14modified by the Department in administrative rules, within 24
15months after the adoption of the administrative rules.
16    (d) The Department shall have the authority and
17responsibility to:
18        (1) Prescribe education and training requirements,
19    which includes training in the use of epinephrine, for all
20    levels of EMS personnel except for EMRs, based on the
21    National EMS Educational Standards and any modifications
22    to those curricula specified by the Department through
23    rules adopted pursuant to this Act.
24            (A) For all levels of EMS personnel, the minimum
25        education and training requirements shall be as
26        follows:

1                (i) All candidates shall hold a high school
2            diploma or high school equivalency certificate and
3            be 18 years of age or older to be licensed.
4                (ii) After completion of an approved education
5            program and a recommendation to test by the EMS
6            Medical Director or the EMS Medical Director's
7            designee, candidates shall take the National
8            Registry of Emergency Medical Technicians
9            cognitive exam, or the exam approved by the
10            Department pursuant to paragraph (2) of this
11            subsection (d), and an EMS System approved
12            psychomotor examination.
13                (iii) Candidates qualifying for licensure
14            examinations may register for examinations through
15            the NREMT or the EMS System administering the
16            licensure examination approved by the Department
17            pursuant to paragraph (2) of this subsection (d).
18            Application information may be found on the NREMT
19            website or on the Department website. All
20            candidates for licensure examinations shall be
21            approved by the EMS System. Candidates shall
22            register to take a licensure examination within 90
23            days after course completion, including all
24            clinical and field requirements.
25                (iv) A failure rate per course of 30% or
26            greater by the third attempt on the licensure

1            examination shall subject the particular education
2            program to review by the EMS System or the
3            Department. The EMS System or the Department shall
4            share failure rates with the EMS Lead Instructor
5            quarterly.
6                (v) Candidates shall complete the licensure
7            examination within 24 months after course
8            completion and initial authorizations to test,
9            and, at no time in those 24 months, shall
10            candidates be required to take additional
11            education and training courses.
12            (B) For EMTs, the minimum education and training
13        requirements shall be as follows:
14                (i) An EMS education program must only be
15            conducted by an EMS System or an academic
16            institution under the direction of the EMS System.
17                (ii) Applications for pre-approval of EMS
18            education programs shall be filed with the
19            Department on forms prescribed by the Department.
20            The applications shall contain, at a minimum:
21                    (I) the name of the applicant, agency, and
22                address;
23                    (II) the EMS Lead Instructor's name,
24                license number, address, and contact
25                information;
26                    (III) the name and signature of the EMS

1                Medical Director and EMS System Coordinator;
2                    (IV) the type of education program;
3                    (V) the dates, times, and location of the
4                education program, including course schedule;
5                    (VI) the goals, objectives, and course
6                outline;
7                    (VII) the methods, materials, and
8                textbooks;
9                    (VIII) the content and time consistent
10                with the national EMS education standards and
11                additional course curricula required by the
12                Department. Initial or modified course syllabi
13                shall be approved by the Department;
14                    (IX) the description of the clinical and
15                field requirements;
16                    (X) the description of evaluation tools
17                (student, clinical units, faculty, and
18                programs); and
19                    (XI) the requirements for successful
20                completion.
21                (iii) Applications for pre-approval, including
22            a copy of the course schedule and syllabus, shall
23            be submitted no less than 60 days before the first
24            scheduled class.
25                    (I) Initial or revised education programs
26                require full submission of all

1                curriculum-related educational documents for
2                Department pre-approval under this
3                subparagraph (B).
4                    (II) Education programs previously
5                approved by the Department without changes to
6                curricula or content require submission of the
7                course schedule and syllabus only.
8                (iv) The EMS Medical Director shall attest on
9            the application form that the education program
10            will be conducted according to the national EMS
11            education standards, including modifications
12            required by the Department. The course hours shall
13            include, at a minimum, 125 hours of didactic
14            education and 25 hours of clinical experience,
15            which includes hospital or alternate health care
16            facility and field internship experience. The
17            clinical experience shall include minimum patient
18            care contacts, competency evaluation, and
19            measurement, as defined in the standards and
20            approved by the EMS Medical Director.
21                (v) The EMS Medical Director and the EMS
22            System Coordinator, in cooperation with the
23            educational institution, shall be responsible for
24            oversight, quality assurance, and outcome
25            measurement for the EMT education program.
26                (vi) The EMS Lead Instructor for the course

1            shall be responsible for ensuring that no EMT
2            course begins until after the Department issues
3            its formal, written pre-approval, which shall be
4            in the form of a numeric site code.
5                (vii) The EMS Lead Instructor for the course
6            shall be responsible for ensuring that all
7            materials presented to EMT students conform to all
8            curriculum requirements of both the Department and
9            the EMS System granting its approval. Methods of
10            assessment or intervention that are not approved
11            by both the Department and the EMS System shall
12            not be taught or presented. All EMS Lead
13            Instructors for courses shall be approved by the
14            EMS Medical Director.
15                (viii) Any change in the EMT program's EMS
16            Medical Director, EMS System Coordinator, or EMS
17            Lead Instructor, or change in the minimum approved
18            program, shall require an amendment to be filed
19            with the Department by the EMS System.
20                (ix) Before a candidate is accepted into the
21            program, documentation shall be submitted that a
22            BLS EMS System vehicle will be available to
23            accommodate field internship needs.
24                (x) Each EMS Lead Instructor shall verify a
25            student's qualification to take a
26            Department-approved licensure examination upon the

1            successful completion of the education program and
2            shall submit a student roster on a form approved
3            by the Department. The EMS Medical Director or the
4            Emergency Medical Director's designee may approve
5            students through an online verification system.
6                (xi) EMT candidates may test for licensure
7            through the NREMT or through the EMS System
8            administering the licensure examination approved
9            by the Department pursuant to paragraph (2) of
10            subsection (d). For EMT candidates who have
11            completed and passed the EMT program, and passed
12            the NREMT examination, the EMS Medical Director or
13            EMS System Coordinator shall submit to the
14            Department an electronic transaction provided by
15            the Department.
16            (C) For A-EMTs, the minimum education and training
17        requirements shall be as follows:
18                (i) An A-EMT course shall be conducted only by
19            an EMS System or an academic institution whose
20            curriculum has been approved by the EMS System.
21                (ii) Applications for pre-approval of A-EMT
22            education programs shall be filed with the
23            Department on forms prescribed by the Department.
24            The application shall contain, at a minimum:
25                    (I) the name of the applicant, agency, and
26                address;

1                    (II) the EMS Lead Instructor's name,
2                license number, address, and contact
3                information;
4                    (III) the name and signature of the EMS
5                Medical Director and the EMS System
6                Coordinator;
7                    (IV) the type of education program;
8                    (V) the dates, times, and locations of the
9                education program, including the course
10                schedule;
11                    (VI) the goals, objectives, and course
12                outline;
13                    (VII) the methods, materials, and
14                textbooks;
15                    (VIII) the content and time consistent
16                with the national EMS education standards and
17                additional course curricula required by the
18                Department. Initial or modified course syllabi
19                shall be approved by the Department;
20                    (IX) the description of the clinical and
21                field requirements;
22                    (X) the description of evaluation tools
23                (student, clinical units, faculty, and
24                programs); and
25                    (XI) the requirements for successful
26                completion.

1                (iii) the applications for pre-approval,
2            including a copy of the course schedule and
3            syllabus, shall be submitted at least 60 days
4            before the first scheduled class.
5                    (I) the initial or revised education
6                programs require full submission of all
7                curriculum-related educational documents for
8                Department pre-approval in this subparagraph
9                (C).
10                    (II) the education programs previously
11                approved by the Department without changes to
12                curricula or content require submission of the
13                course schedule and syllabus only.
14                (iv) The EMS Medical Director shall attest on
15            the application form that the A-EMT education
16            program shall be conducted according to the
17            national EMS education standards for an A-EMT,
18            including modifications required by the
19            Department. The course hours shall minimally
20            include 200 hours of didactic education and at
21            least 150 hours of clinical experience. Clinical
22            experience shall include hospital, alternate care
23            facility, and field internship experience,
24            including minimum patient care contacts,
25            competency evaluation and measurement, as defined
26            in the standards and approved by the EMS Medical

1            Director.
2                (v) The oversight, quality assurance, and
3            outcome measurement for the A-EMT education
4            program shall be the responsibility of the EMS
5            Medical Director and the EMS System Coordinator,
6            with cooperation of the educational institution.
7                (vi) The EMS Lead Instructor shall be
8            responsible for ensuring that no A-EMT course
9            begins before the Department issues its formal
10            written pre-approval, which will be in the form of
11            a numeric site code.
12                (vii) The EMS Lead Instructor for the course
13            shall be responsible for ensuring that all
14            materials presented to A-EMT students conform to
15            all curriculum requirements of both the Department
16            and the EMS System granting its approval. Methods
17            of assessment or intervention that are not
18            approved by both the Department and the EMS System
19            shall not be taught or presented. All EMS Lead
20            Instructors for courses must be approved by the
21            EMS Medical Director.
22                (viii) Any change in the A-EMT program's EMS
23            Medical Director, EMS System Coordinator, or EMS
24            Lead Instructor, or change in the minimum approved
25            program, requires an amendment to be filed with
26            the Department.

1                (ix) A candidate for an A-EMT education
2            program shall have a current Illinois EMT license.
3            All program participants shall maintain their
4            qualifying license throughout completion of the
5            program and successful completion of the licensure
6            examination.
7                (x) Before a candidate is accepted into the
8            program, documentation shall be submitted that an
9            ILS or ALS EMS System vehicle will be available to
10            accommodate field internship needs.
11                (xi) Each education program shall verify a
12            student's qualification to attempt a Department
13            approved licensure examination upon the successful
14            completion of the education program and shall
15            submit a student roster on a form approved by the
16            Department. The EMS Medical Director or the
17            Medical Director's designee may approve students
18            through an online verification system.
19                (xii) A-EMT candidates who have completed and
20            passed all components of the program may test for
21            licensure through the NREMT or the EMS System
22            administering the licensure examination approved
23            by the Department pursuant to paragraph (2) of
24            this subsection (d). After successfully passing
25            the appropriate licensure examination, candidates
26            may apply for Illinois licensure through the EMS

1            System on forms provided by the Department.
2                (xiii) All approved programs shall maintain
3            course and student records, for a minimum of 7
4            years, in compliance with affiliated academic
5            institution requirements as applicable. The course
6            and student records shall be made available to the
7            EMS System or Department upon demand.
8            (D) For paramedics, the minimum education and
9        training requirements shall be as follows:
10                (i) An accredited Paramedic program shall be
11            conducted only by an EMS System or an academic
12            institution whose curriculum has been approved by
13            the EMS System or by direct approval from the
14            Department upon submission and confirmation that
15            all accreditation requirements have been met,
16            including clinical sites.
17                (ii) Applications for pre-approval of
18            Paramedic education programs shall be filed with
19            the Department on forms prescribed by the
20            Department. The application shall contain, at a
21            minimum:
22                    (I) the name of the applicant, agency, and
23                address;
24                    (II) the EMS Lead Instructor's name,
25                license number, address, and contact
26                information;

1                    (III) the name and signature of EMS
2                Medical Director and EMS System Coordinator;
3                    (IV) the type of education program;
4                    (V) the dates, times, and location of the
5                education program, including course schedule;
6                    (VI) the goals, objectives, and course
7                outline;
8                    (VII) the methods, materials, and
9                textbooks;
10                    (VIII) the content and time, consistent
11                with the national EMS education standards and
12                additional course curricula required by the
13                Department. Initial or modified course syllabi
14                shall be approved by the Department;
15                    (IX) the description of the clinical and
16                field requirements;
17                    (X) the description of evaluation tools
18                (student, clinical units, faculty, and
19                programs); and
20                    (XI) the requirements for successful
21                completion.
22                (iii) Applications for pre-approval, including
23            a copy of the course schedule and syllabus, shall
24            be submitted at least 60 days before the first
25            scheduled class.
26                    (I) Initial or revised education programs

5                    (II) Education programs previously
6                approved by the Department without changes to

9                (iv) The EMS Medical Director of the EMS
10            System shall attest on the application form that
11            the education program will be conducted according
12            to the national EMS education standards, including
13            all modifications required by the Department. The
14            course hours shall minimally include 500 hours of
15            didactic education and 500 hours of clinical
16            experience, which includes hospitals plus
17            alternate care facilities and field internship
18            experience, including minimum patient care
19            contacts and competency evaluation and measurement
20            as defined in the standards and approved by the
21            EMS Medical Director.
22                (v) Oversight, quality assurance, and outcome
23            measurement for the Paramedic education program
24            shall be the responsibility of the EMS Medical
25            Director and the EMS System Coordinator, with
26            cooperation of the educational institution.

1                (vi) The EMS Lead Instructor for the course
2            shall be responsible for ensuring that no
3            Paramedic class begins until after the Department
4            issues its formal written pre-approval, which
5            shall be in the form of a numeric site code.
6                (vii) The EMS Lead Instructor for the course
7            shall be responsible for ensuring that all
8            materials presented to Paramedic students conform
9            to all curriculum requirements of both the
10            Department and the EMS System granting its
11            approval. Methods of assessment or intervention
12            that are not approved by both the Department and
13            the EMS System shall not be taught or presented.
14            All EMS Lead Instructors for courses must be
15            approved by the EMS Medical Director.
16                (viii) Any change in the Paramedic program's
17            EMS Medical Director, EMS System Coordinator, or
18            EMS Lead Instructor, or change in the minimum
19            approved program, shall require an amendment to be
20            filed with the Department.
21                (ix) A candidate for a Paramedic education
22            program shall have an active Illinois EMT, A-EMT,
23            or EMT-I license. All program participants shall
24            maintain their qualifying license throughout
25            completion of the program and successful
26            completion of the licensure examination.

1                (x) Before a candidate is accepted into the
2            program, documentation shall be submitted that an
3            ALS or Critical Care Transport EMS System vehicle
4            will be available to accommodate field internship
5            needs.
6                (xi) Each education program shall verify a
7            student's qualification to attempt a Department
8            approved licensure examination upon the successful
9            completion of the education program and shall
10            submit a student roster on a form approved by the
11            Department. The EMS Medical Director or the
12            Emergency Medical Director's designee may approve
13            students through an online verification system.
14                (xii) Paramedic candidates may test for
15            licensure through the NREMT examination, which
16            requires successful completion from an accredited
17            academic institution recognized by the NREMT, or
18            the EMS System administering the licensure
19            examination approved by the Department pursuant to
20            paragraph (2) of this subsection (d). For
21            Paramedic candidates who have completed and passed
22            all components of the program, passed the
23            appropriate licensure examination, and are
24            applying for Illinois licensure, the EMS Medical
25            Director shall submit to the Department an
26            electronic transaction form provided by the

1            Department. No electronic transaction form is
2            required for candidates taking the State licensure
3            examination.
4                (xiii) All approved programs shall maintain
5            course and student records for 7 years, in
6            compliance with the affiliated academic
7            institution requirements as applicable. The course
8            and student records shall be made available to the
9            EMS System or Department upon request.
10        (2) Prescribe licensure testing requirements for all
11    levels of EMS personnel, which shall include: (i) a
12    requirement that all phases of instruction, training, and
13    field experience be completed before taking the
14    appropriate licensure examination; and (ii) an option for
15    virtual instruction for any non-practical skills training
16    or non-field experience instruction. The Department shall
17    approve a written and practical licensure examination
18    administered by the EMS Medical Director of an EMS System
19    as one option for an appropriate licensure examination to
20    candidates. Candidates may elect to take the appropriate
21    National Registry examination in lieu of the Department's
22    examination, but are responsible for making their own
23    arrangements for taking the National Registry examination.
24    In prescribing licensure testing requirements for
25    honorably discharged members of the armed forces of the
26    United States under this paragraph (2), the Department

1    shall ensure that a candidate's military emergency medical
2    training, emergency medical curriculum completed, and
3    clinical experience, as described in paragraph (2.5), are
4    recognized.
5        (2.5) Review applications for EMS personnel licensure
6    from honorably discharged members of the armed forces of
7    the United States with military emergency medical
8    training. Applications shall be filed with the Department
9    within one year after military discharge and shall
10    contain: (i) proof of successful completion of military
11    emergency medical training; (ii) a detailed description of
12    the emergency medical curriculum completed; and (iii) a
13    detailed description of the applicant's clinical
14    experience. The Department may request additional and
15    clarifying information. The Department shall evaluate the
16    application, including the applicant's training and
17    experience, consistent with the standards set forth under
18    subsections (a), (b), (c), and (d) of Section 3.10. If the
19    application clearly demonstrates that the training and
20    experience meet such standards, the Department shall offer
21    the applicant the opportunity to successfully complete a
22    Department-approved EMS personnel examination for the
23    level of license for which the applicant is qualified.
24    Upon passage of an examination, the Department shall issue
25    a license, which shall be subject to all provisions of
26    this Act that are otherwise applicable to the level of EMS

1    personnel license issued.
2        (3) License individuals as an EMR, EMT, EMT-I, A-EMT,
3    or Paramedic who have met the Department's education,
4    training and examination requirements.
5            (i) To be licensed by the Department as an EMT,
6        A-EMT, EMT-I, or Paramedic, an individual must pass
7        the NREMT examination or the written and practical
8        licensure examination approved by the Department and
9        administered by the EMS Medical Director of an EMS
10        System.
11            (ii) Within 24 months after certification, the
12        applicant shall apply for initial licensure to the
13        Department through the EMS System that sponsored the
14        education program, using forms specified by the
15        Department. The application shall include demographic
16        information, social security number, child support
17        statement, felony conviction statement, and applicable
18        fees prescribed by the Department in rule and shall
19        require EMS System authorization.
20            (iii) An EMS license shall specify the level of
21        licensure and be effective for a period of 4 years.
22            (iv) An EMT, A-EMT, EMT-I, or Paramedic shall
23        notify the Department within 30 days after any change
24        in name or address. The notification may be in person
25        or by mail, phone, fax, or electronic mail. Addresses
26        may be changed through the Department's online system.

1        Name and gender changes require certified copies of
2        court orders, including marriage licenses or court
3        documents.
4        (4) Prescribe annual continuing education and
5    relicensure requirements for all EMS personnel licensure
6    levels.
7        (5) Relicense individuals as an EMD, EMR, EMT, EMT-I,
8    A-EMT, PHRN, PHAPRN, PHPA, or Paramedic every 4 years,
9    based on their compliance with continuing education and
10    relicensure requirements as required by the Department
11    pursuant to this Act. Every 4 years, a Paramedic shall
12    have 100 hours of approved continuing education, an EMT-I
13    and an advanced EMT shall have 80 hours of approved
14    continuing education, and an EMT shall have 60 hours of
15    approved continuing education. An Illinois licensed EMR,
16    EMD, EMT, EMT-I, A-EMT, Paramedic, ECRN, PHPA, PHAPRN, or
17    PHRN whose license has been expired for less than 36
18    months may apply for reinstatement by the Department.
19    Reinstatement shall require that the applicant (i) submit
20    satisfactory proof of completion of continuing medical
21    education and clinical requirements to be prescribed by
22    the Department in an administrative rule; (ii) submit a
23    positive recommendation from an Illinois EMS Medical
24    Director attesting to the applicant's qualifications for
25    retesting; and (iii) pass a Department approved test for
26    the level of EMS personnel license sought to be

1    reinstated.
2        (6) Grant inactive status to any EMR, EMD, EMT, EMT-I,
3    A-EMT, Paramedic, ECRN, PHAPRN, PHPA, or PHRN who
4    qualifies, based on standards and procedures established
5    by the Department in rules adopted pursuant to this Act.
6        (7) Charge a fee for EMS personnel examination,
7    licensure, and license renewal.
8        (8) Suspend, revoke, or refuse to issue or renew the
9    license of any licensee, after an opportunity for an
10    impartial hearing before a neutral administrative law
11    judge appointed by the Director, where the preponderance
12    of the evidence shows one or more of the following:
13            (A) The licensee has not met continuing education
14        or relicensure requirements as prescribed by the
15        Department;
16            (B) The licensee has failed to maintain
17        proficiency in the level of skills for which he or she
18        is licensed;
19            (C) The licensee, during the provision of medical
20        services, engaged in dishonorable, unethical, or
21        unprofessional conduct of a character likely to
22        deceive, defraud, or harm the public;
23            (D) The licensee has failed to maintain or has
24        violated standards of performance and conduct as
25        prescribed by the Department in rules adopted pursuant
26        to this Act or his or her EMS System's Program Plan;

1            (E) The licensee is physically impaired to the
2        extent that he or she cannot physically perform the
3        skills and functions for which he or she is licensed,
4        as verified by a physician, unless the person is on
5        inactive status pursuant to Department regulations;
6            (F) The licensee is mentally impaired to the
7        extent that he or she cannot exercise the appropriate
8        judgment, skill and safety for performing the
9        functions for which he or she is licensed, as verified
10        by a physician, unless the person is on inactive
11        status pursuant to Department regulations;
12            (G) The licensee has violated this Act or any rule
13        adopted by the Department pursuant to this Act; or
14            (H) The licensee has been convicted (or entered a
15        plea of guilty or nolo contendere) by a court of
16        competent jurisdiction of a Class X, Class 1, or Class
17        2 felony in this State or an out-of-state equivalent
18        offense.
19        (9) Prescribe education and training requirements in
20    the administration and use of opioid antagonists for all
21    levels of EMS personnel based on the National EMS
22    Educational Standards and any modifications to those
23    curricula specified by the Department through rules
24    adopted pursuant to this Act.
25    (d-5) An EMR, EMD, EMT, EMT-I, A-EMT, Paramedic, ECRN,
26PHAPRN, PHPA, or PHRN who is a member of the Illinois National

1Guard or an Illinois State Trooper or who exclusively serves
2as a volunteer for units of local government with a population
3base of less than 5,000 or as a volunteer for a not-for-profit
4organization that serves a service area with a population base
5of less than 5,000 may submit an application to the Department
6for a waiver of the fees described under paragraph (7) of
7subsection (d) of this Section on a form prescribed by the
8Department.
9    (d-10) A person who is not an EMS personnel may operate an
10EMS vehicle pursuant to this Act if the following requirements
11are met: (i) the person meets the requirements of Section
1211-1421 of the Illinois Vehicle Code; and (ii) 2 EMS personnel
13are present. If a waiver is issued by the Department, the
14person who is not an EMS personnel may operate the EMS vehicle
15if only one EMS personnel is present. Upon request, the
16Department may issue a retroactive waiver when appropriate.
17Deference shall be given to the EMS Medical Director of an EMS
18System when a waiver is requested.
19    The education requirements prescribed by the Department
20under this Section must allow for the suspension of those
21requirements in the case of a member of the armed services or
22reserve forces of the United States or a member of the Illinois
23National Guard who is on active duty pursuant to an executive
24order of the President of the United States, an act of the
25Congress of the United States, or an order of the Governor at
26the time that the member would otherwise be required to

1fulfill a particular education requirement. Such a person must
2fulfill the education requirement within 6 months after his or
3her release from active duty.
4    (e) In the event that any rule of the Department or an EMS
5Medical Director that requires testing for drug use as a
6condition of the applicable EMS personnel license conflicts
7with or duplicates a provision of a collective bargaining
8agreement that requires testing for drug use, that rule shall
9not apply to any person covered by the collective bargaining
10agreement.
11    (f) At the time of applying for or renewing his or her
12license, an applicant for a license or license renewal may
13submit an email address to the Department. The Department
14shall keep the email address on file as a form of contact for
15the individual. The Department shall send license renewal
16notices electronically and by mail to a licensee who provides
17the Department with his or her email address. The notices
18shall be sent at least 60 days prior to the expiration date of
19the license.

23    Sec. 3.55. Scope of practice.
24    (a) Any person currently licensed as an EMR, EMT, EMT-I,
25A-EMT, PHRN, PHAPRN, PHPA, or Paramedic may perform emergency

1and non-emergency medical services as defined in this Act, in
2accordance with his or her level of education, training and
3licensure, the standards of performance and conduct prescribed
4by the Department in rules adopted pursuant to this Act, and
5the requirements of the EMS System in which he or she
6practices, as contained in the approved Program Plan for that
7System. The Director may, by written order, temporarily modify
8individual scopes of practice in response to public health
9emergencies for periods not exceeding 180 days.
10    (a-5) EMS personnel who have successfully completed a
11Department approved course in automated defibrillator
12operation and who are functioning within a Department approved
13EMS System may utilize such automated defibrillator according
14to the standards of performance and conduct prescribed by the
15Department in rules adopted pursuant to this Act and the
16requirements of the EMS System in which they practice, as
17contained in the approved Program Plan for that System.
18    (a-7) An EMT, EMT-I, A-EMT, PHRN, PHAPRN, PHPA, or
19Paramedic who has successfully completed a Department approved
20course in the administration of epinephrine shall be required
21to carry epinephrine with him or her as part of the EMS
22personnel medical supplies whenever he or she is performing
23official duties as determined by the EMS System. The
24epinephrine may be administered from a glass vial,
25auto-injector, ampule, or pre-filled syringe.
26    (b) An EMR, EMT, EMT-I, A-EMT, PHRN, PHAPRN, PHPA, or

1Paramedic may practice as an EMR, EMT, EMT-I, A-EMT, or
2Paramedic or utilize his or her EMR, EMT, EMT-I, A-EMT, PHRN,
3PHAPRN, PHPA, or Paramedic license in pre-hospital or
4inter-hospital emergency care settings or non-emergency
5medical transport situations, under the written or verbal
6direction of the EMS Medical Director. For purposes of this
7Section, a "pre-hospital emergency care setting" may include a
8location, that is not a health care facility, which utilizes
9EMS personnel to render pre-hospital emergency care prior to
10the arrival of a transport vehicle. The location shall include
11communication equipment and all of the portable equipment and
12drugs appropriate for the EMR, EMT, EMT-I, A-EMT, or
13Paramedic's level of care, as required by this Act, rules
14adopted by the Department pursuant to this Act, and the
15protocols of the EMS Systems, and shall operate only with the
16approval and under the direction of the EMS Medical Director.
17    This Section shall not prohibit an EMR, EMT, EMT-I, A-EMT,
18PHRN, PHAPRN, PHPA, or Paramedic from practicing within an
19emergency department or other health care setting for the
20purpose of receiving continuing education or training approved
21by the EMS Medical Director. This Section shall also not
22prohibit an EMT, EMT-I, A-EMT, PHRN, PHAPRN, PHPA, or
23Paramedic from seeking credentials other than his or her EMT,
24EMT-I, A-EMT, PHRN, PHAPRN, PHPA, or Paramedic license and
25utilizing such credentials to work in emergency departments or
26other health care settings under the jurisdiction of that

1employer.
2    (c) An EMT, EMT-I, A-EMT, PHRN, PHAPRN, PHPA, or Paramedic
3may honor Do Not Resuscitate (DNR) orders and powers of
4attorney for health care only in accordance with rules adopted
5by the Department pursuant to this Act and protocols of the EMS
6System in which he or she practices.
7    (d) A person student enrolled in a Department approved EMS
8personnel program or a person who has completed a Department
9approved EMS personnel program who has not yet completed the
10appropriate licensure examination , while fulfilling the
11clinical training and in-field supervised experience
12requirements mandated for licensure or approval by the System
13and the Department, may perform prescribed procedures under
14the direct supervision of a physician licensed to practice
15medicine in all of its branches, a qualified registered
16professional nurse, or qualified EMS personnel if the person:
17(i) is 17 years of age or older; (ii) has completed the first
1840 hours of an EMT training program that included a CPR course,
19a defensive driving course, and training on the operation of
20an ambulance pursuant to Section 11-1421 of the Illinois
21Vehicle Code; and (iii) is currently enrolled in a Department
22approved EMS personnel program or completed the program within
23the last 24 months , only when authorized by the EMS Medical
24Director. At no time may a person allowed to perform
25procedures pursuant to this subsection under the direct
26supervision of a physician licensed to practice medicine in

1all of its branches, a qualified registered professional
2nurse, or qualified EMS personnel be the primary caregiver
3during transport.
4    (e) An EMR, EMT, EMT-I, A-EMT, PHRN, PHAPRN, PHPA, or
5Paramedic may transport a police dog injured in the line of
6duty to a veterinary clinic or similar facility if there are no
7persons requiring medical attention or transport at that time.
8For the purposes of this subsection, "police dog" means a dog
9owned or used by a law enforcement department or agency in the
10course of the department or agency's work, including a search
11and rescue dog, service dog, accelerant detection canine, or
12other dog that is in use by a county, municipal, or State law
13enforcement agency.
14    (f) Nothing in this Act shall be construed to prohibit an
15EMT, EMT-I, A-EMT, Paramedic, or PHRN from completing an
16initial Occupational Safety and Health Administration
17Respirator Medical Evaluation Questionnaire on behalf of fire
18service personnel, as permitted by his or her EMS System
19Medical Director.
20    (g) An EMT, EMT-I, A-EMT, Paramedic, PHRN, PHAPRN, or PHPA
21shall be eligible to work for another EMS System for a period
22not to exceed 2 weeks if the individual is under the direct
23supervision of another licensed individual operating at the
24same or higher level as the EMT, EMT-I, A-EMT, Paramedic,
25PHRN, PHAPRN, or PHPA; obtained approval in writing from the
26EMS System's Medical Director; and tests into the EMS System

1based upon appropriate standards as outlined in the EMS System
2Program Plan. The EMS System within which the EMT, EMT-I,
3A-EMT, Paramedic, PHRN, PHAPRN, or PHPA is seeking to join
4must make all required testing available to the EMT, EMT-I,
5A-EMT, Paramedic, PHRN, PHAPRN, or PHPA within 2 weeks after
6the written request. Failure to do so by the EMS System shall
7allow the EMT, EMT-I, A-EMT, Paramedic, PHRN, PHAPRN, or PHPA
8to continue working for another EMS System until all required
9testing becomes available.
10    (h) A member of a fire department's or fire protection
11district's collective bargaining unit shall be eligible to
12work under a silver spanner program for another EMS System's
13fire department or fire protection district that is not the
14full-time employer of that member, for a period not to exceed 2
15weeks, if the member: (1) is under the direct supervision of
16another licensed individual operating at the same or higher
17licensure level as the member; (2) made a written request to
18the EMS System's Medical Director for approval to work under
19the silver spanner program, which shall be approved or denied
20within 24 hours after the EMS System's Medical Director
21received the request; and (3) tests into the EMS System based
22upon appropriate standards as outlined in the EMS System
23Program Plan. The EMS System within which the member is
24seeking to join must make all required testing available to
25the member within 2 weeks of the written request. Failure to do
26so by the EMS System shall allow the member to continue working

6    Sec. 3.65. EMS Lead Instructor.
7    (a) "EMS Lead Instructor" means a person who has
8successfully completed a course of education as approved by
9the Department, and who is currently approved by the
10Department to coordinate or teach education, training and
11continuing education courses, in accordance with standards
12prescribed by this Act and rules adopted by the Department
13pursuant to this Act.
14    (b) The Department shall have the authority and
15responsibility to:
16        (1) Prescribe education requirements for EMS Lead
17    Instructor candidates through rules adopted pursuant to
18    this Act.
19        (2) Prescribe testing requirements for EMS Lead
20    Instructor candidates through rules adopted pursuant to
21    this Act.
22        (3) Charge each candidate for EMS Lead Instructor a
23    fee to be submitted with an application for an
24    examination, an application for licensure, and an
25    application for relicensure.

1        (4) Approve individuals as EMS Lead Instructors who
2    have met the Department's education and testing
3    requirements.
4        (5) Require that all education, training and
5    continuing education courses for EMT, EMT-I, A-EMT,
6    Paramedic, PHRN, PHPA, PHAPRN, ECRN, EMR, and Emergency
7    Medical Dispatcher be coordinated by at least one approved
8    EMS Lead Instructor. A program which includes education,
9    training or continuing education for more than one type of
10    personnel may use one EMS Lead Instructor to coordinate
11    the program, and a single EMS Lead Instructor may
12    simultaneously coordinate more than one program or course.
13    An EMS Lead Instructor may oversee a paramedic with at
14    least 3 years of experience to teach EMT classes, with a
15    licensed teacher, in high schools. High school students
16    electing to not take the National Registry of Emergency
17    Medical Technicians (NREMT) Certification exam shall not
18    be accounted for in calculating the course pass rate by
19    the EMS System or Department.
20        (6) Provide standards and procedures for awarding EMS
21    Lead Instructor approval to persons previously approved by
22    the Department to coordinate such courses, based on
23    qualifications prescribed by the Department through rules
24    adopted pursuant to this Act.
25        (7) Suspend, revoke, or refuse to issue or renew the
26    approval of an EMS Lead Instructor, after an opportunity

1    for a hearing, when findings show one or more of the
2    following:
3            (A) The EMS Lead Instructor has failed to conduct
4        a course in accordance with the curriculum prescribed
5        by this Act and rules adopted by the Department
6        pursuant to this Act; or
7            (B) The EMS Lead Instructor has failed to comply
8        with protocols prescribed by the Department through
9        rules adopted pursuant to this Act.
10    (c) To be eligible for an EMS Lead Instructor license, the
11applicant shall meet at least the following minimum experience
12and education requirements and shall provide a written
13recommendation from the EMS Medical Director of the primary
14EMS System affiliation:
15        (1) a current Illinois license as an EMD, EMT, EMT-I,
16    A-EMT, Paramedic, RN, PHRN, PHPA, PHAPRN, or physician;
17        (2) a minimum of 2 years of experience in EMS or
18    emergency care;
19        (3) at least 2 years of documented teaching
20    experience;
21        (4) at least 6 hours of teaching hours audited by a
22    current EMS Lead Instructor;
23        (5) documented EMS classroom teaching experience with
24    a recommendation for EMS Lead Instructor licensure by an
25    EMS Medical Director or licensed EMS Lead Instructor; and
26        (6) documented successful completion of the National

1    Standard Curriculum for EMS Instructors, or its
2    equivalent, as approved by the Department.

5    Sec. 3.260. Emergency Medical Services Bridge Programs in
6Higher Education Task Force.
7    (a) The Emergency Medical Services Bridge Programs in
8Higher Education Task Force is created to investigate and
9develop policy recommendations regarding the development of
10bridge programs at institutions of higher education to
11encourage individuals to transition to or from careers as EMS
12personnel.
13    (b) The Emergency Medical Services Bridge Programs in
14Higher Education Task Force shall address, study, and provide
15recommendations on the development of any bridge program
16deemed appropriate by the Task Force, including, but not
17limited to, the following:
18        (1) a bridge program that encourages and allows
19    individuals licensed as certified nursing assistants to
20    transition to a career as an EMS personnel; and
21        (2) a bridge program that encourages and allows EMS
22    personnel to transition to a career as a nursing
23    professional licensed under the Illinois Nurse Practice
24    Act.
25    (c) The Task Force shall be comprised of the following

1members:
2        (1) one member of the General Assembly, appointed by
3    the President of the Senate, who shall serve as co-chair;
4        (2) one member of the General Assembly, appointed by
5    the Speaker of the House of Representatives, who shall
6    serve as co-chair;
7        (3) one member of the General Assembly, appointed by
8    the Minority Leader of the Senate;
9        (4) one member of the General Assembly appointed by
10    the Minority Leader of the House of Representatives;
11        (5) the Director of Public Health or the Director's
12    designee;
13        (6) the Director of Commerce and Economic Opportunity
14    or the Director's designee;
15        (7) 9 members representing private ground ambulance
16    providers throughout this State representing for-profit
17    and non-profit rural and urban ground ambulance providers,
18    appointed by the President of the Senate;
19        (8) one member representing the State Board of
20    Education, appointed by the Minority Leader of the House
21    of Representatives;
22        (9) 2 EMS Medical Directors from a Regional EMS
23    Medical Directors Committee, appointed by the Governor;
24        (10) one member representing the Illinois Community
25    College Systems, appointed by the Minority Leader of the
26    Senate; and

1        (11) one member representing the University of
2    Illinois Systems, appointed by the Speaker of the House of
3    Representatives.
4    (d) Members of the Task Force shall serve without
5compensation.
6    (e) The Department of Public Health shall provide
7administrative and technical support to the Task Force and be
8responsible for administering its operations and ensuring that
9the requirements of the Task Force are met. All appointments
10to the Task Force shall be made within 30 days after the
11effective date of this amendatory Act of the 104th General
12Assembly.
13    (f) The Task Force shall convene at the call of the
14co-chairs and shall hold at least 6 meetings, with the first
15meeting to occur within 60 days after the effective date of
16this amendatory Act of the 104th General Assembly.
17    (g) The Task Force shall submit its final report
18containing legislative and policy decisions to the General
19Assembly and the Governor no later than December 31, 2026, and
20upon the submission of its final report, the Task Force shall
21be dissolved.
22    (h) This Section is repealed on June 1, 2027.
 
23    Section 99. Effective date. This Act takes effect upon
24becoming law.".
