| 2 | | WHEREAS, The Illinois State Court of Claims determines and |
| 3 | | pays out Certificate of Innocence awards under 705 ILCS 505; |
| 4 | | and
|
| 5 | | WHEREAS, The Illinois General Assembly has been working on |
| 6 | | legislation to make the Certificate of Innocence awards more |
| 7 | | equitable in keeping with federally recommended minimum |
| 8 | | standards; and
|
| 9 | | WHEREAS, All of the interested parties are in general |
| 10 | | agreement that such change is needed but have been unable to |
| 11 | | resolve the specificity of the statutory language needed; |
| 12 | | therefore, be it
|
| 13 | | RESOLVED, BY THE SENATE OF THE ONE HUNDRED FOURTH GENERAL |
| 14 | | ASSEMBLY OF THE STATE OF ILLINOIS, that we encourage the State |
| 15 | | Court of Claims to pause on Certificate of Innocence payouts |
| 16 | | if requested by the Certificate of Innocence awardee and their |
| 17 | | attorney(s) until the legislature works through the nuances of |
| 18 | | the Certificate of Innocence statutory language by June 30, |
| 19 | | 2026. |
