Synopsis As Introduced
Amends the Downstate Teacher Article of the Illinois Pension Code. In provisions requiring an additional employer contribution for certain salary increases greater than 6%, provides that the System shall exclude salary increases given on or after July 1, 2025 resulting from overload work, including summer school, when the school district has certified to the System, and the System has approved the certification, that (i) the overload work is for the sole purpose of classroom instruction in excess of the standard number of classes for a full-time teacher in a school district during a school year and (ii) the salary increases are equal to or less than the rate of pay for classroom instruction computed on the teacher's current salary and work schedule. Effective immediately.
Pension Note (Government Forecasting & Accountability)
HB 2564, as engrossed exempts school districts from having to compensate TRS for salary increases over 6% that compose a teachers’ final average salary (FAS), contingent upon it being the result of “overload work” on or after July 1, 2025. Overload work is defined as summer school or educational work in excess of the standard number of classes assigned to a teacher. The fiscal impact of HB 2564, as engrossed, is commensurate with the number of teachers engaged in overload work in any given school year. To the extent that exemptions to the FAS Cap would be granted that would otherwise not be allowed under current law, there would be a slight negative impact upon TRS. As of its June 2024 valuation, TRS has an unfunded liability of $82.9 billion, and a funding ratio of 46.3%.

Senate Floor Amendment No. 1
Replaces everything after the enacting clause. Reinserts the provisions of the engrossed bill with the following changes. In provisions requiring an additional employer contribution for certain salary increases greater than 6%, provides that the System shall exclude salary increases given on or after the effective date of the amendatory Act resulting from overload work, summer school, or stipend work when the school district has certified to the System, and the System has approved the certification, that the overload work, summer school, or the stipend work is for the sole purpose of classroom instruction in excess of the standard number of classes for a full-time teacher in a school district during a school year (instead of shall exclude salary increases given on or after July 1, 2025 resulting from overload work, including summer school, when the school district has certified to the System, and the System has approved the certification, that (i) the overload work is for the sole purpose of classroom instruction in excess of the standard number of classes for a full-time teacher in a school district during a school year and (ii) the salary increases are equal to or less than the rate of pay for classroom instruction computed on the teacher's current salary and work schedule). Effective immediately.
