AN ACT concerning State government.
|
Be it enacted by the People of the State of Illinois,
|
represented in the General Assembly:
|
Section 5. The Children and Family Services Act is amended |
by changing Section 12 as follows:
|
(20 ILCS 505/12) (from Ch. 23, par. 5012)
|
Sec. 12. (a) To provide supervision, housing |
accommodations, board or the
payment of boarding costs, |
tuition, and treatment free of charge, except as
otherwise |
specified in this Act, for residents of this State who are |
cared
for in any institution, or for persons receiving services |
under any program
under the jurisdiction of the Department. |
Residents of other states may be
admitted upon payment of the |
costs of board, tuition, and treatment as
determined by the |
Department; provided, that no resident of another state
shall |
be received or retained to the exclusion of any resident of |
this
State. The Department shall accept any donation for the |
board, tuition, and
treatment of any person receiving service |
or care.

(b) To By July 1, 1994, to make room and board payments to |
persons
providing foster care under this Act at a rate for each |
child that is up to
100% of the adjusted United States |
Department of Agriculture Cost of
Raising a Child in the Urban |
|
Midwest/Low Cost Index.
|
By March 1, 2010 and March 1 of each year thereafter, the |
Department of Children and Family Services shall report to the |
Governor and General Assembly the estimated cost and additional |
funding required to establish the rate for each child up to |
100% of the Foster Care Minimum Adequate Rates for Children |
(MARC) for expenditures allowable under the federal Title IV-E |
Foster Care Maintenance Program of the Social Security Act |
related to the actual costs of providing food, clothing, |
shelter, daily supervision, school supplies, personal |
incidentals, and insurance, jointly recommended by the |
National Foster Parent Association, the University of Maryland |
School of Social Work, and the organization Children's Rights |
in a technical report entitled "Hitting the M.A.R.C.: |
Establishing Foster Care Minimum Adequate Rates for Children", |
dated October 2007. |

Section 99. Effective date. This Act takes effect upon |
becoming law.
