AN ACT concerning eye care coverage.
| ||||
Be it enacted by the People of the State of Illinois,
| ||||
represented in the General Assembly:
| ||||
Section 1. Short title. This Act may be cited as the | ||||
Topical Eye Medication Prescription Act. | ||||
Section 5. Coverage. Every insurer that amends, delivers, | ||||
issues, or renews an individual or group policy of accident and | ||||
health insurance in this State that provides coverage for | ||||
prescription topical eye medication shall not deny coverage for | ||||
the refilling of a prescription for topical eye medication | ||||
when: | ||||
(1) the medication is to treat a chronic condition of | ||||
the eye; | ||||
(2) the refill is requested by the insured prior to the | ||||
last day of the prescribed dosage period and after at least | ||||
75% of the predicted days of use; and | ||||
(3) the prescribing physician licensed to practice | ||||
medicine in all its branches or optometrist indicates on | ||||
the original prescription that refills are permitted and | ||||
that the early refills requested by the insured do not | ||||
exceed the total number of refills prescribed.
