SUBPART A: GENERAL

 

Section 2070.10  Definitions

 

a)         "Act" as used in this part means the "Illinois Controlled Substances Act," effective August 16, 1971, as amended.

 

b)         The definitions contained in Section 102 of the Act are applicable herein, unless the context otherwise requires.

 

Section 2070.20  Designated Products

 

The Department finds that the following Controlled Substances listed in Schedule II (Subpart C) require use of an official prescription blank for dispensation:  any narcotic drug, amphetamine, glutethimide, phenmetrazine, methamphetamine, pentazocine, or cannabis product.

Section 2070.30  Names Given to Listed Drugs

 

The controlled substances listed or to be listed in the schedules contained in this part are included by whatever official, common, usual, chemical or trade name designated.

 

Section 2070.40  Excluded Substances

 

The non-narcotic substances excluded from all schedules of the Federal Controlled Substances Act (21 U.S.C. 801 et seq.) as of January 1, 1974, pursuant to Section 1308.22 of the Code of Federal Regulations (21 CFR 1308.22), are excluded from all schedules of the Act.

 

Section 2070.50  Excepted Compounds

 

The compounds in the form excepted from application of certain specified sections of the Federal Controlled Substances Act (21 U.S.C. 801 et seq.), the Federal Controlled Substances Import and Export Act (21 U.S.C. 951 et seq.), and the Code of Federal Regulations, pursuant to Section 1308.32 of the Code of Federal Regulations(21 C.F.R. 1308.32) are excepted from the application of Sections 312 and 313 of this Act.

Unless specifically excepted or unless listed in another schedule, any of the following opiates listed in Sections 2070.120 to 2070.395, including their isomers, esters, ethers, salts, and salts of isomers, esters, and ethers, whenever the existence of such isomers, esters, ethers, and salts is possible within the specific chemical designation:

The Department may except by rule any compound, mixture, or preparation containing any depressant substance listed in Section 2070.2110 from the application of all or any part of this Act if the compound, mixture, or preparation contains one or more active medicinal ingredients not having a depressant effect on the central nervous system, and if the admixtures are included therein in combinations, quantity, proportion, or concentration that vitiate the potential for abuse of the substances which have a depressant effect on the central nervous system.

Any material, compound, mixture, or preparation that contains any quantity of the following substance listed in Section 2070.2655 having a stimulant effect on the central nervous system, including its salts, enantiomers (optical isomers) and salts of enantiomers (optical isomers).

Ephedrine as the only active medicinal ingredient or in combination with therapeutically insignificant quantities of another active medicinal ingredient.  Anything less than 200 milligrams of Guaifenesin shall be considered therapeutically insignificant.

Any compound, mixture, or preparation containing limited quantities of any of the following narcotic drugs listed in Sections 2070.2715 to 2070.2740, or their salts calculated as the free anhydrous base or alkaloid, which also contains one or more non-narcotic active medicinal ingredients in sufficient proportion to confer upon the compound, mixture or preparation, valuable medicinal qualities other than those possessed by the narcotic drug alone.
