TITLE 20: CORRECTIONS, CRIMINAL JUSTICE, AND LAW ENFORCEMENT
CHAPTER I: DEPARTMENT OF CORRECTIONS SUBCHAPTER d: PROGRAMS AND SERVICES PART 420 ASSIGNMENT OF COMMITTED PERSONS SECTION 420.40 REMOVAL/REASSIGNMENT
Section 420.40 Removal/Reassignment
a) A committed person may be removed from his assignment and/or reassigned by the Chief Administrative Officer, or by the Assignment Officer with subsequent approval by the Chief Administrative Officer. Removal and/or reassignment shall be based upon matters including, but not limited to, the committed person's inability or incompetence in performing or completing the assignment, disciplinary reasons, the committed person's request for an assignment change, staff recommendation, security or administrative reasons.
b) Placement in segregation status shall result in the removal of an adult committed person from his assignment.
1) When a committed person is found not guilty of a rule violation in accordance with Part 504, or an investigation indicates that he did not commit a violation, he may be returned to the assignment he held prior to being removed. Factors to be considered may include, but not be limited to, the availability of the assignment, basis for the finding of not guilty, results of the investigation or staff recommendation.
2) When a committed person is found guilty of a rule violation in accordance with Part 504, he shall, upon release from segregation status, be given an assignment other than the assignment held prior to being placed in segregation, unless return to the same assignment is approved in writing by the Chief Administrative Officer.
c) Removal or reassignments shall be made in accordance with Section 420.30.
