Section 615.621  Applicability

This Subpart applies to any existing unit for the storage and handling of fertilizers that is located wholly or partially within a setback zone or regulated recharge area and that:

a)         Is operated for the purpose of commercial application; or

b)         Stores or accumulates fertilizers prior to distribution to retail sales outlets, including a unit that is a warehouse or bulk terminal.

c)         Despite subsections (a) and (b), this Subpart does not apply to any unit exempt under Section 615.105.
