Section 121.154  Court Imposed Disqualification

a)         Individuals found guilty of intentional violation of the program by a court are disqualified for the length of time specified by the court.  If the court fails to impose a specific period of disqualification the individual is disqualified for the time period specified in Section 121.151.

b)         If the individual is currently participating in the program, the period of disqualification begins within 45 days of the date of the court decision.

c)         If the individual is not participating in the Food Stamp Program at the time of the court decision, disqualification is postponed until the individual is again found eligible to receive Food Stamps.  Once the disqualification is imposed, it continues regardless of the eligibility of the disqualified member's household.

d)         In cases where the determination of intentional program violation is reversed by a court of appropriate jurisdiction, the local office is to reinstate the individual in the program if the household is currently participating.  Benefits lost as a result of the disqualification shall be restored.
