AMENDMENT TO SENATE BILL 1773




2    AMENDMENT NO. ______. Amend Senate Bill 1773 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Illinois Public Aid Code is amended by 
5changing Section 11-4.1 as follows:
 
6    (305 ILCS 5/11-4.1)
7    Sec. 11-4.1. Medical providers assisting with applications 
8for medical assistance. A provider enrolled to provide medical 
9assistance services may, upon the request of an applicant 
10individual, accompany, represent, and assist the applicant 
11individual in applying for medical assistance under Article V 
12of this Code, including the pursuit of any appeals related to 
13the application, on behalf of the applicant during the 
14applicant's life and after the applicant's death. If an 
15applicant individual is unable to request such assistance due 
16to incapacity or mental incompetence and has no other

1representative willing or able to assist in the application 
2process,  a facility licensed under the Nursing Home Care Act, 
3the ID/DD Community Care Act, or the MC/DD Act or certified 
4under this Code is authorized to assist the applicant 
5individual in applying  for long-term care services, including 
6the pursuit of any appeals related to the application, on 
7behalf of the applicant during the applicant's life and after 
8the applicant's death.  Subject to the provisions of   the Free 
9Healthcare Benefits Application Assistance Act, nothing in 
10this Section shall be construed as prohibiting any individual 
11or entity from assisting another individual in applying for 
12medical assistance under Article V of this Code.

14    Section 99. Effective date. This Act takes effect upon 
15becoming law.".
