AMENDMENT TO SENATE BILL 1773

AMENDMENT NO. ______. Amend Senate Bill 1773, AS AMENDED, with reference to page and line numbers of House Amendment No. 4 as follows:

on page 52, line 15, by replacing "and 5A-16 as" with "5A-16, and 5A-17 as"; and

on page 131, immediately below line 15, by inserting the following:

"(c) This Section does not apply to Section 5A-17."; and

on page 133, immediately below line 8, by inserting the following:

"(305 ILCS 5/5A-17 new)

Sec. 5A-17. Safety-Net Gap Payments.

(a) Payments under this Section are to protect access to care in vulnerable communities served by safety-net hospitals. Payments made under this Section must be made in State Fiscal Year 2019 and each subsequent State Fiscal Year during any month for which federal financial participation under Title XIX of the Social Security Act is not available for the payments under Section 5A-12.5 or the payments under subsections (d) and (f) of Section 14-12.

(b) For the purposes of this Section, safety-net hospitals which qualify for payments under this Section are:

(1) hospitals which meet the criteria under Section 5-5e.1 for the period October 1, 2016 through September 30, 2017; or

(2) hospitals licensed as Illinois freestanding psychiatric hospitals which meet the criteria under Section 5-5e.1 for the period October 1, 2016 through September 30, 2017 with the exception of licensure as a general acute-care hospital.

(c) Payments made under this Section in each State Fiscal Year beginning with State Fiscal Year 2019 must be made to each hospital in an amount equal to what the hospital received in State Fiscal Year 2018 under Section 5A-12.5 and the payments under subsections (d) and (f) of Section 14-12.

(d) If a new payment program is approved by the federal Centers for Medicare and Medicaid Services to receive federal financial participation under Title XIX of the Social Security Act which replaces the payments authorized under Sections 5A-12.2, 5A-12.4, and 5A-12.5 and under subsection (d) of Section 14-12, then any payments made under the new program which retroactively overlap time periods in which a payment was made under this Section must be reduced by the Department in the respective time period by the amount of the safety-net gap payment made under this Section.

(e) Payments under this Section must be made regardless of federal approval for federal financial participation under Title XIX of the Social Security Act. Section 5A-15 is inapplicable to this Section.".
