| 2 | AMENDMENT NO. ______. Amend House Bill 2100, AS AMENDED, | ||||||
| 3 | with reference to page and line numbers of House Amendment No. | ||||||
| 4 | 3, as follows:
| ||||||
| 5 | on page 15, immediately below line 5, by inserting the | ||||||
| 6 | following: | ||||||
| 7 | "(b-5) Beginning on July 1, 2020, the State Board of | ||||||
| 8 | Education may charge a charter school that it authorizes a fee | ||||||
| 9 | not to exceed 3% of the revenue provided to the school to be | ||||||
| 10 | used exclusively for covering the cost of authorizing | ||||||
| 11 | activities. Authorizing activities may include, but are not | ||||||
| 12 | limited to: (i) soliciting, reviewing, and taking action on | ||||||
| 13 | charter school proposals; (ii) hiring, training, and | ||||||
| 14 | supervising staff engaged in authorizing activities; (iii) | ||||||
| 15 | developing and conducting oversight, including regular | ||||||
| 16 | monitoring, of authorized charter schools; (iv) reporting on | ||||||
| 17 | best practices and performances of charter schools; (v) | ||||||
| |||||||
| |||||||
| 1 | applying for, managing, and distributing grants and funds | ||||||
| 2 | appropriated for charter schools and authorizing activities; | ||||||
| 3 | (vi) training members of the State Board on their authorizing | ||||||
| 4 | roles; and (vii) training other employees of the State Board on | ||||||
| 5 | how to work with charter schools as their own local education | ||||||
| 6 | agencies."; and
| ||||||
| 7 | on page 27, by replacing line 12 with the following: | ||||||
| 8 | "revoke or not renew a charter unless it determines that doing | ||||||
| 9 | so is in the best interests of the students currently enrolled | ||||||
| 10 | in the charter school."; and | ||||||
| 11 | on page 27, line 16, by replacing "placed" with "offered | ||||||
| 12 | placement"; and
| ||||||
| 13 | on page 27, by replacing line 18 with the following: | ||||||
| 14 | "Student Succeeds Act accountability plan, and that they have | ||||||
| 15 | reasonable options for transportation to those schools. In | ||||||
| 16 | determining"; and | ||||||
| 17 | by replacing line 26 on page 27 through line 11 on page 28 with | ||||||
| 18 | the following:
| ||||||
| 19 | "Commission and the State Board. The State Board Commission may | ||||||
| 20 | reverse a local board's decision to not renew a charter if the | ||||||
| 21 | State Board Commission finds that the charter school or charter | ||||||
| 22 | school proposal (i) is in compliance with this Article, and | ||||||
| |||||||
| |||||||
| 1 | (ii) is in the best interests of the students it is designed to | ||||||
| 2 | serve. The State Board Commission may condition the granting of | ||||||
| 3 | an appeal on the acceptance by the charter school of funding in | ||||||
| 4 | an amount less than that requested in the proposal submitted to | ||||||
| 5 | the local school board. Final decisions of the State Board | ||||||
| 6 | Commission shall be subject to judicial review under the | ||||||
| 7 | Administrative Review Law. | ||||||
| 8 | (f) Notwithstanding other provisions of this Article, if | ||||||
| 9 | the State Board Commission
on appeal reverses a local board's | ||||||
| 10 | decision to not renew a charter
or".
