AMENDMENT TO SENATE BILL 854 

2    AMENDMENT NO. ______. Amend Senate Bill 854, AS AMENDED, 
3by replacing Section 10 with the following:
4    "Section 10. The Illinois Administrative Procedure Act is 
5amended by changing and renumbering Section 5-45.35, as added 
6by Public Act 102-1115, as follows:
 
7    (5 ILCS 100/5-45.44)
8    (Section scheduled to be repealed on January 9, 2024)
9    Sec. 5-45.44 5-45.35. Emergency rulemaking; Hate Crimes 
10and Bias Incident Prevention and Response Fund and Local 
11Chambers of Commerce Recovery Grants. To provide for the 
12expeditious and timely implementation of Public Act 102-1115 
13this amendatory Act of the 102nd General Assembly, emergency 
14rules implementing Section 6z-138 of the State Finance Act may 
15be adopted in accordance with Section 5-45 by the Department 
16of Human Rights and emergency rules implementing Section 
17605-1105 of the Department of Commerce and Economic

1Opportunity Law of the Civil Administrative Code of Illinois 
2may be adopted in accordance with Section 5-45 by the 
3Department of Commerce and Economic Opportunity. The adoption 
4of emergency rules authorized by Section 5-45 and this Section 
5is deemed to be necessary for the public interest, safety, and 
6welfare.
7    This Section is repealed on March 31, 2024 one year after 
8the effective date of this amendatory Act of the 102nd General 
9Assembly.
